AN ORDINANCE. • Amending Sections 6-7-2-8(B), 6-9-2, 6-9-2-2(A)l and 6-9-2-lQ of the Evanston City Code (Parking in Certain B Districts) WHEREAS, the Evanston Zoning Amendment Committee conducted public hearings pursuant to a reference from the City Council on July 9, 1981, August 13, 1981, September 10, 1981, October 15, 1981, November 5, 1981, November 19, 1981, December 3, 1981, January 5, 1982, February 4, 1982, February 11, 1982, March 4, 1982, April 15, 1982, June 3, 1982, June 17, 1982, July 1, 1982, July 22, 1982, August 5, 1982, September 2, 1982, October 7, 1982, • November.4, 1982, December 2, 1982, January 6, 1983, January 20, 1983, February 3, 1983, February 17, 1983, March 3, 1983, and March 24, 1983, to consider amending the off-street parking regulations applicable to the Central Business District, Sections 6-7-2 and 6-9-2 of the City Code of the City of Evanston; and. • WHEREAS, the Zoning Amendment Committee has recommended that Sections 6-7-2-8(B), 6-9-2, 6-9-2-2 and 6-9-2-10 of said Code be amended, NOW, THEREFORE, BE IT ORDAINED .BY THE CITY COUNCIL OF THE CITY OF EVAPJSTON., COOK COUNTY, ILLINOIS: SECTION 1: That Section 6-7-2-8 "OFF-STREET LOADING AND PARKING" be amended, amending 6-7-2-8(B)3 and adding new subsections (B)4 and B(5) so that.the full Section B shall read as follows: 6-7-2-8: OFF-STREET LOADING AND:.PARKING: (B) •Off -Street Parking: 1. In B1 and B2 Districts, parking shall be provided in accordance with the provisions set forth in•Section 6-9-2. 2. In B3, B4 and B5 Districts, parking spaces for residential .._: and hotel uses shall be provided in accordance with the provisions set forth in Section 6-9-2. ' 3. In the B3 District, parking spaces for uses other than (1) residential and (2) hotel uses shall be provided in accordance with the following specified percentage of the requirements set • forth in Section 6-9-2: 4 In a B3 District, sixty percent (60%) 7/28/83 i 50-0-83 i 4. In B4 and B5 Districts,.parking spaces for: a. (1) Medical or dental clinics and offices for doctors or dentists, (2) restaurants or theatres which.open before 6:00 p.m. on any weekday and (3) special uses, shall be • provided in accordance with the following specified per- centagas of the requirements set forth in Section 6-9-2-10. (1) In a B4 District, fifty percent (50%). I (2) In a B5 District, forty percent (40%). i b. Permitted uses other than (1) residential, (2) hotel, (3) medical or dental clinics and offices for doctors or • j dentists, and (4) restaurants and theaters which open before 6:00 p.m. on any weekday, shall provide off-street parking according to the following requirements: • i (1) In a B4 District, one parking stall for each four hundred (400) square feet of floor area in excess of two. thousand (2,000) square feet. (2) In a B5 District, one parking stall for each four hundred (400) square feet of floor area in excess of two thousand (2,000) square feet. c. Notwithstanding any other requirements, including Section 6-9-2, the use of any floor area in the B4 and B5 Business District in a building either existing on January 24, 1983,. or which, if constructed subsequently, has been issued a certificate of use and occupancy (excluding provisional approval of occupancy) that..has been in effect for at least • one year, may be changed to'any permitted use other than resi- dential and hotel uses without providing the parking spaces necessary to meet the "amount of resulting increase" that otherwise would.b.e required by Section 6-9-2, and provided further that any off-street.parking stalls which existed as required parking on January"24, 1983, or which were there- after provided as required parking for buildings located in B4 and B5 Districts may not be eliminated. i 5. In B3, B4 and B5 Districts where not less than eighty percent �(80%) of the required parking is -located below grade, the number ' of required parking spaces may be further reduced by ten percent (10%) of the requirements previously specified in Section 6-9-2-10. i SECTION 2: That Section 6-9-2 of the Evanston Zoning Ordinance be amended to read as•follows: 6-9-2: OFF-STREET PARKING: In connection with any structure hereafter erected, ofi'=street parking spaces shall be. provided meeting all the minimum requirements of this Section. Any parking space hereafter installed shall be improved so as to meet all the minimum requirements hereof. jWhenever any structure is either altered so as to increase the "Floor Area --for determining off-street parking and loading requirements" as defined herein, or a use or uses (as set forth in Section 6-9-2-10) • are changed, or both, so as to increase the minimum parking requirements ! as calculated by application of the formulae in said Section 6-9-2-10, i parking spaces shall be provided (or leased from the City in accordance with Section 6-9-2-2(A)4) equal to the amount of the resulting increase; provided that in no case shall more spaces be required than are neces- sary to meet the minimum requirements as set forth in Section 6-9-2-10.
