HomeMy WebLinkAboutORDINANCES-1983-140-O-8312/14/83 • 140-0-83 AN ORDINANCE Amending'Section 7-10-4 of the City Code Relating to James Park Regulations WHEREAS, the City Council reduced the Recreation Department 1983 budget for James Hill; and WHEREAS, this budget reduction dictated substantial curtailment of use.a.t the James Hill; and WHEREAS, James Hill is appropriately signed and fenced to restrict use to only a designated section; and WHEREAS, that use is now expressly and specifically designated to an area at the north side of the hill; and WHEREAS, said area and use is for sledding cnly; and WHEREAS, all other activity permitted under existing ordinance is now prohibited; NOW', THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF • THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 7-10-4 of the City Code of the City of Evanston, 1979, as amended, be and is hereby further amended to read as follows: 7-10-4: JAMES PARK REGULATIONS: i (A) James Hill on the East, West, and South sides is closed to the public. Public use of these sides is strictly prohibited. Use of these sides shall constitute a trespass. (B) James Hill on the .fenced portion of the North side is restricted to use for standard sledding in Winter months when natural.weather conditions permit. Other ' use is strictly prohibited. Use other than for sledding as provided herein, shall constitute a trespass. (C) When the North side is used for sledding, as pro- vided herein, the user assumes the full risk and responsibility of determining that all conditions are safe for sledding and assumes the full risk and • responsibility of all injury --caused by the user or the City's maintenance or lack of maintenance.of the hill. (D) The City simply makes the hill available for r 140-0-83 L_J sledding when natural conditions, in the judgment of the user, permit and does not undertake to maintain the hill for sledding or to provide any supervision. (E) Parents are responsible for the care and super- vision of their children.
