AN ORDINANCE
Authorizing the Sale of
a Portion of 1817 Church Street
WHEREAS, the City of Evanston owns the following
described real property:
Parcel 2: That portion of Lot 13 in Block 3 in
Merrill Ladd's Second Addition to Evanston, being a
subdivision of the West 1/2 of the Southwest 1/4 of
the Northeast 1/4 of Section 13, Township 41 North,
Range 13, East of the Third Principal Meridian,
described as follows: Beginning at the N.W. corner
of the East 10 feet of said Lot 13, thence Westerly
20 feet along the north line of said Lot 13; thence
Southerly 76.0 feet, along the east line of the East
10 feet of said Lot 13; thence Easterly 20 feet,
parallel with the North line of said Lot 13, to the
West line of the East 10 feet of said Lot 13; thence
Northerly along the West line of said East 10 feet of
said Lot 13, 76.0 feet to the place of beginning, all
in Cook County, Illinois; and
commonly known as a portion of 1817 Church Street, which
property is located in the City of Evanston, Illinois; and
WHEREAS, the City Council of the City of Evanston has
determined that it is no longer necessary, appropriate, or in
the best interests of the City of Evanston that it retain title
to said real estate, and that said real estate is not required
for the use of, or profitable to, the City of Evanston; and
WHEREAS, the City Council of the City of Evanston has
determined that the best interests of the City of Evanston
would be served by the sale of said property; and
WHEREAS, pursuant to Ordinance 120-0-84 of the City
of Evanston, the City Council by a vote of 2/3 of the elected
aldermen then holding office did direct that the process to
sell shall be by a negotiated sale and that the City Manager
shall be authorized to negotiate on behalf of the City; and
WHEREAS, pursuant to said ordinance, said
negotiations have occurred; and
` WHEREAS, the City Manager recommends that a sale
between the City of Evanston and Family Focus, Inc. be accepted
by the City. The contract for said sale, marked as Exhibit A,

is attached hereto and incorporated herein by reference; and

WHEREAS, the City Council finds and determines that
the best interests of the City of Evanston and its residents
will be served by the acceptance of the contract for sale on
the terms as set forth in Exhibit A; and
WHEREAS, the notice of intent to sell has been
published in a newspaper of general circulation in the City of
Evanston as required by ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the City Council of the City of
Evanston finds as fact the recitals
hereinabove set forth.
SECTION 2: The negotiated contract for sale of a
portion of 1817 Church Street to Family Focus, Inc., as set
forth in Exhibit A hereto, is hereby accepted by the City
Council of the City of Evanston for the following described
real estate:
Parcel 2: That portion of Lot 13 in Block 3 in
Merrill Ladd's Second Addition to Evanston, being a
subdivision of.the West 1/2 of the Southwest 1/4 of
the Northeast 1/4 of Section 13, Township 41 North,
Range 13, East of the Third Principal Meridian,
described as follows: Beginning at the N.W. corner
of the East 10 feet of said Lot 13, thence Westerly
20 feet along the North line of said Lot 13; thence
Southerly 76.0 feet, along the east line of the East
10 feet of said Lot 13; thence Easterly 20 feet,
parallel with the North line of said Lot 13, to the
West line of the East 10 feet of said Lot 13; thence
Northerly along the West line of said East 10 feet of
said Lot 13, 76.0 to the place of beginning, all in
Cook County, Illinois; and
commonly known as a portion of 1817 Church Street.
SECTION 3: The City Manager is hereby authorized
and directed to sign, and the City Clerk is hereby authorized
and directed to attest, a contract for the sale of the
aforesaid real estate, which contract shall be in accordance

SECTION 4: Upon satisfaction of the terms of
the aforesaid contract, and upon the
payment or securing of the purchase price, the Mayor is hereby
authorized and directed to convey and transfer the aforesaid
• real estate to Family Focus, Inc. by a proper deed of
conveyance, stating therein the consideration as set forth in
Exhibit A, and the City Clerk is hereby authorized to.
acknowledge and attest such deed, and to affix thereto the Seal
of the City of Evanston.
SECTION 5: The Mayor and the Clerk are hereby
authorized respectively, to execute and
attest such other documents as may be necessary to the
conveyance herein authorized.
SECTION 6: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.

SECTION 7: This ordinance shall be in full force
and effect from and after its passage,
approval, and publication in the manner provided by law.

C O N T R A C T
THIS CONTRACT, made and entered into this day
of January, 1985 by and between the City of Evanston, an
Illinois municipal corporation, and Family Focus, Inc., an
Illinois not -for -profit corporation.
WITNESSETH, that the Seller agrees to sell and
convey, and the Purchaser agrees to purchase.
All that certain plot, piece or parcel of land, with
the improvements thereon erected, situate, lying and being in:
Parcel 2: That portion of Lot 13 in Block 3 in Merrill
Ladd's Second Addition to Evanston, being a subdivision of
the West 1/2 of the Southwest 1/4 of the Northeast 1/4 of
Section 13, Township 41 North, Range 13, East of the Third
Principal Meridian, described as follows: Beginning at
the N.W. corner of the East 10 feet of said Lot 13, thence
Westerly 20 feet along the north line of said Lot 13;
thence Southerly 76.0 feet, along the east line of the
East 10 feet of said Lot 13; thence Easterly 20 feet,
parallel with the North line of said Lot 13, to the West
line of the East 10 feet of said Lot 13; thence Northerly
along the West line of said East 10 feet of said Lot 13,
76.0 to the place of beginning, all in Cook County,
Illinois commonly known as a portion of 1817 Church
Street.
IN CONSIDERATION THEREOF, the Purchaser agrees to pay
to the said Seller the sum of Three Thousand Forty Dollars
($3040.00)in the following manner, to wit: Cash or certified
check at closing.
Seller agrees to convey title free and clear of all
encumbrances, except as herein set forth on title commitment,
• attached hereto as Exhibit A, by a good and sufficient
quitclaim deed.
