HomeMy WebLinkAboutORDINANCES-1984-120-O-8410/4/84 n LJ is • 120-0-84 Authorizing the Conveyance by Negotiation of Certain Real Estate Located at 1817 Church Streeet, Evanston, Illinois WHEREAS, the City of Evanston is desirous of selling a portion of certain real estate located at 1817 Church Street in Evanston, Illinois, said portion legally described as follows: Parcel 2: That portion of Lot 13 in Block 3 in Merrill Ladd's Second Addition to Evanston, being a subdivision of the West 1/2 of the Southwest 1/4 of the Northeast 1/4 of Section 13, Township 41 North, Range 13, East of the Third Principal Meridian, described as follows: Beginning at the N.W. corner of the East 10 feet of said Lot 13, thence Westerly 20 feet along the North line of said Lot 13; thence Southerly 76.0 feet, parallel 'with the West line of the East 10 feet of said Lot 13; thence'Easterly 20 feet, parallel with the North line of said Lot 13, to the West line of the East 10 feet of said Lot 13; thence Northerly along the West line of said East 10 feet of said Lot 13, to the place of beginning, all in Cook County, Illinois; and WHEREAS, said property, contiguous to 1819 Church Street, is a small parcel presently used as a parking area for 1819 Church Street behind which it is located, and is of no use ij or benefit to the City owned real estate at 1817 Church Street; and ! WHEREAS, in the opinion of the corporate authorities of the City of Evanston, ownership of said real estate is no longer necessary, appropriate, required for the use of, i profitable to or in the best interest of the City of Evanston; and WHEREAS, the corporate authorities of the City of Evanston have determined that the City's best interest would be served by the conveyance of said real estate by means of negotiation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the City Manager or his designee be and is hereby authorized and directed to 120-0-84 negotiate the sale of subject property at 1817 Church legally described as j Parcel 2: That portion of Lot 13 in Block 3 in ' �! Such negotiations shall include but not be limited to the purchase price and any other terms and conditions of conveyance deemed appropriate by the City Manager. Pursuant to Evanston City Code Section 1-17-4-2(B) an affirmative vote of two-thirds (2/3) of the elected aldermen is required to accept the recommendation of the City Manager authorized herein. The City Manager reserves the right to reject any and all negotiations. • SECTION 2: The City Manager is hereby author- ized and directed to give notice of intent to sell subject real estate as a result of negotiated sale. Such Notice of Intent to Sell must be published at least once in a daily or weekly newspaper in general circulation in the city, not less than 15 not more than 30 days before the date on which the City Council shall consider the adoption of the ordinance directing the sale of subject property. SECTION 3: That the Notice of Intent to Sell subject real estate shall be in substantially the following form: NOTICE OF INTENT TO SELL AS RESULT OF NEGOTIATION Public notice is hereby given that on • , 1984, the City Council of the City of Evanston, at its regular meeting at 9:00 P.M. in the City Council Chambers of the Evanston Civic Center at 2100 Ridge Avenue, proposes to approve the sale of -2- • is • 120-0-84- the following legally described real estate, to wit: Parcel 2: That portion of Lot 13 in Block 3 in Merrill Ladd's Second Addition to Evanston, being a subdivision of the West 1/2 of the Southwest 1/4 of the Northeast 1/4 of Section 13, Township 41 North, Range 14 13, East of the Third Principal Meridian, described as follows: Beginning at the N.W. corner of the East 10 feet of said Lot 13, thence Westerly 20 feet along the North line of said Lot 13; thence Southerly 76.0 feet, parallel with the West line of the East 10 feet of said Lot 13; thence Easterly 20 feet, parallel with the North line of said Lot 13, to the West line of the East 10 feet of said Lot 13; thence Northerly along the West line of said East 10 feet of said Lot 13, to the place of beginning, all in Cook County, Illinois commonly known as 1817 Church Street. Said property is presently used for parking and has been previously authorized by City Council Ordinance 120-0-84 to be sold by negotiation, pursuant to City Code Section 1-17-4-2,at a price and according to terms and conditions determined by the City Manager and approved by City Council. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
