AN ORDINANCE
Granting the Application of the American
National Bank of Chicago as Trustee under
Trust No. 14451 for a Variation from the
Off -Street Parking Provisions of the Zoning
Ordinance and other Relief in Connection with
the Property Located at 1406 Chicago Avenue
WHEREAS, on November 4, 1975 and December 16, 1975
the Zoning Board of Appeals conducted public hearings upon the
f application of the American National Bank of Chicago as Trustee
j under trust No. 14451, Ben P. Seltz, Leonard W. Golan, and
Carol P. Golan, beneficiaries, for a variation from the
off-street parking regulations and relief from the conditions
imposed by ordinance 86-0-71 to allow a reduction in the number
of required off-street parking spaces on the property located
at 1406 Chicago Avenue, Evanston, Illinois, an R7 General
Residence District, said public hearing having been conducted
pursuant to notice and publication thereof as provided by law;
and
WHEREAS, the Zoning Board of Appeals has recommended
that such relief be granted subject to the following
conditions:
1. That ten (10) off-street parking spaces, meeting all
the requirements of the Zoning Ordinance, shall be
provided;
2. That three (3) additional off-street parking spaces
shall be leased from the City; and
3. That the variation granted herein. shall be limited to
the present use of the property as a skilled and
intermediate term nursing care facility serving no
more than 145 patients, all in accordance with the
recommendations of the Zoning Board of Appeals.
WHEREAS, in the matter of the Pembridqe House, Inc.
v. the City of Evanston Case No. 82-C 2710 in the United States
District Court for the Northern District of Illinois, the
• shareholders of Pembridge House, Inc., acting through the
American National Bank of Chicago, as Trustee under Trust No.
94-0-84
14451 (the applicant herein) sought to modify the aforesaid
conditions; and

WHEREAS, on or about May 28, 1984,.the City of

±� Evanston and Pembridge House entered into an Agreed Order for
the purpose of terminating and settling all pending matters of
controversy between the parties in order to avoid further

litigation; and
WHEREAS, by the terms of said Agreed Order the City
of Evanston agreed to the adoption of an appropriate ordinance
granting said zoning variation;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
' SECTION 1: That the application of the American
National Bank of Chicago as Trustee under
Trust No. 14451, Ben P. Seltz, Leonard W. Golan, and Carol P.
Golan, beneficiaries, for a variation from the off-street
parking provisions of the Zoning Ordinance and relief from the
• conditions imposed by Ordinance 86-0-71 to allow a reduction in
the number of required off-street parking spaces from 34 to 10
for the property located at 1406 Chicago Avenue, Evanston,
Illinois, and legally described as
Lot 8 in Lakeside Subdivision of Block 30 in the Village
of Evanston in Section 18, Township 41 North, Range 14
east of the Third Principal Meridian in Cook County,
Illinois
is hereby granted, pursuant to the terms of the aforesaid
Agreed Order as follows: Said 10 off-street parking spaces may
be located on that certain property at Greenwood and Sherman
Place presently owned by the American National Bank of Chicago,
as trustee under Trust Agreement dated May 25, 1983 and known
as Trust No. 57845; that said location is recognized as a legal
• location for the construction of the aforesaid off-street
parking spaces required for the operation of a nursing home
facility located at 1406 Chicago Avenue, Evanston, Illinois, so

long as the requirements of the Zoning Ordinance are met with
regard to the construction of the spaces therein, the access
thereto and other physical requirements of the Zoning
• Ordinance, and subject to compliance with all other applicable
laws, and the condition that the variation granted herein shall
be limited to the present use of the property as a skilled and
intermediate term nursing care facility serving no more than
145 patients.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
approval, and publication in the manner provided by law.
