HomeMy WebLinkAboutORDINANCES-1984-082-O-845/30/84 6/6/84 AN ORDINANCE • Adopting the National Electrical Code, 1984 by Reference and Amending Title 4, Chapter 7, Sections 1-4 and Section 9 of the City Code of the City of Evanston WHEREAS, the City Council of the City of Evanston considers it in the public interest to adopt as its standard for construction, alteration, and installation of electrical work the National Electrical code, 1984 Edition; and WHEREAS, the City Council of the City of Evanston has caused three (3) copies of the aforesaid Code to be kept on file in the office of the City Clerk for public inspection for a period of more than thirty (30) days prior to the adoption of f this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: • SECTION 1: That Title 4, Chapter 7, Section 1-4 and Section 9 of the City Code of the City of Evanston, 1979, as amended, be further amended to read as follows: 4-7-1: ADOPTION OF NATIONAL ELECTRICAL CODE: Pursuant to authority granted by Chapter 24, Section 1-2-4, Illinois Revised Statutes, and pursuant to its home rule powers, the City of Evanston hereby adopts, by reference, as criteria for the issuance of construction, reconstruction, alteration or installation permits, the provisons of the National Electrical Code, 1984 Edition. 4-7-2: APPLICATION OF REGULATIONS: The regula- tions of the National Electrical Code, 1984 Edition, shall apply to all matters concerning the construction, reconstruction, alteration or installation of all electrical wiring apparatus, fixtures, machinery or devices, and their service equipment, and shall apply to all existing or proposed buildings and structures in the City. 4-7-3: AMENDMENTS AND EXCEPTIONS TO THE CODE: • The following sections of the National Electrical Code, 1984 Edition, are amended to read as follows: (A) CHAPTER 3 1. Section 336-11, Devices of Insulating Material, is hereby deleted in its entirety. (B) CHAPTER 4 is 1. Section 410.8, Fixtures in Clothes Closets, is hereby amended to read as follows: "Section 410-8. Fixtures in Clothes Closets. "(a) A fixture shall be installed in every clothes closet within an area of eight (8) square feet or larger. "(b) A fixture in a clothes closet. shall be installed: 11(1) On the wall above the closet door, provided clearance between the fixture and a storage area where combustible material may be stored within the closet is not less than 18 inches, or 11(2) On the ceiling over an area which is unobstructed to the floor, maintaining an 18 inch clearance horizontally between the fixture and a storage area where combustible material may be stored within the closet. "NOTE: A flush recessed fixture with a solid lens, or an approved ceiling -mounted fluorescent fixture, or a totally enclosed approved surface • incandescent fixture shall be permitted to be installed, provided there is a 6-inch (152-mm) clearance horizontally between the fixture and the storage area. "(c) Pendants shall not be installed in clothes closets." 2. Section 422-24, Unit Switches as Disconnecting Means, is hereby amended to read as follows: "Section 422-24, Unit Switches as Disconnecting Means. "(a) Unit switches which are a part of an appliance shall not be considered as taking the place of the disconnecting means required by Part D (Control and Protection of Appliances) of this Article, unless there are other means for disconnection as follows: "(1) Multi -family Dwellings. In multi -family (more than two) dwellings, the disconnecting means shall be within the apartment, or on the same floor as the apartment in which the appliance is installed, and may control lamps • and other appliances. -2- "(2) Two -Family Dwellings. In two-family dwellings, the disconnecting means may be outside the apartment in which the appliance is installed. This will permit an individual switch for the apartment to be used. • "(3) In Single -Family Dwellings. In single-family dwellings, the service disconnecting means may be used. 11 "(4) Other Occupancies. In other occupancies, the branch -circuit switch or circuit breaker, where readily accessible to the user of the appliance, may be used for this purpose. "(b) A dishwasher shall have a fused type "S" disconnect switch readily accessible under the kitchen sink. A disposal without a unit switch shall. have a switch installed in the wall or under the sink. Any changes from the provisions of this section (b) shall be approved by the Director of Building & Zoning of the City of Evanston. 3. Article 336 of the 1984 Code shall be deleted in its entirety. 4-7-9: PENALTY: Any person who shall violate any provisions of the National Electrical Code, 1981 Edition, or who shall fail to comply with any of the requirements thereof, or who shall change, move or alter any wiring apparatus, fixture, machinery, or device in violation of any approved plan or direction of the Director of the Department of Building & Zoning or of any permit or certificate issued under the provisions of the National Electrical Code, 1984 Edition, shall be guilty of an offense, punishable by a fine of not less than fifty dollars ($50.00) or more than five hudnred dollars ($500.00). A separate offense shall be deemed committed for each day such violation shall occur or continue.. SECTION 2: It is the intention of the City Council that the provisions of this ordinance and the National Electrical Code, 1984 Edition, are severable and the invalidity of any section or part of any section of this ordinance and the code hereby adopted shall not affect any other section or portion of said ordinance or code. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: This ordinance shall be in full force -3- 82-0-84 and effect from and after its passage, approval, and publication in the manner provided by law.
