HomeMy WebLinkAboutORDINANCES-1984-030-O-8411/30/83 2/22 /84 30-0-84 AN ORDINANCE Amending Sections 6-2-4, 6-3-3, 6-3-4, 6-3-6-1(C) and 6-3-6-1(D), and 6-7-2-.2"R" of the Zoning • Ordinance Concerning Permitted Uses for Antennas WHEREAS, the Evanston Zoning Amendment Committee conducted public hearings on July 7, 1983; July 21, 1983; August 4, 1983; August 18, 1983; September 1, 1983; September 15, 1983; October 6, 1983; October 20, 1983; November 3, 1983; and November 17, 1983 to consider amending the Evanston Zoning Ordinance to provide in which districts and under what conditions all antennas for transmitting and receiving radio, television and other electronic signals should be allowed, including but not limited to toc•Ters, satellite and microwave relay antennas, said public hearings having been conducted pursuant to notice and publication thereof, in the manner prescribed by law; and WHEREAS, based on the evidence presented, findings of • fact, existing conditions, conservation of property values, and the direction of building development to the best advantage of the entire city, the Zoning Amendment Committee has recommended that certain amendments are clearly favored by a preponderance of the evidence and are required for the public good; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COM<1 COUNTY, ILLINOIS: SECTION 1: That Section 6-2-4 of the City Code of the City of Evanston, 1979, as amended, is hereby further amended to add the following definition of antenna: ANTENNA: An apparatus, external to or attached to the exterior of a building, together with any supporting structure, for sending or receiving electromagnetic waves. An - is tennas may be principal or accessory structures. 30-0-84 SECTION 2: That Section 6-3-3 of the City Code of the City of Evanston, 1979, as amended, is hereby further amended by changing the title from is "Building Height" to "Height Exceptions", numbering the existing paragraph, not now numbered, paragraph 1, and the following paragraph 2 is added: 2. Height exceptions for accessory antennas are contained in Section 6-3-4. SECTION 3: That Section 6-3-4 of the City Code of .the City of Evanston, 1979, as amended, is hereby further amended by changing the -title from"ACCESSORY BUILDINGS AND USES" to "ACCESSORY BUILDINGS, STRUCTURES AND USES" and by adding the following new subsection (G): (G) Antennas accessory to permitted uses are hereby authorized in the zoning districts specified hereunder. New antennas accessory to an existing or ! proposed special use require special use approval per j( Section 6-3-5. All antennas, whether authorized as a permitted or special use, are subject to the • following requirements: j 1. In any zoning district other than a residence district, roof -mounted accessory antennas of any type may be erected on the roof of the principal building. to a maximum height of thirty-five (35') feet above the maximum height of the building on which it is � located. However, the.following additional requirements shall also apply to roof -mounted satellite earth stations and microwave relay j antennas: I a. Satellite earth stations and microwave relay i antennas shall hot be visible between ground level � and ten feet (.L0') above ground level from any street i adjoining the lot. I b. Satellite earth stations shall not exceed ten feet (10') •indiameter. Microwave relay antennas shall not exceed four feet (4') in diameter. C. Satellite earth stations, microwave relay antennas, and their accompanying support structures i shall be neutral in color and, to the extent 1 possible, compatible with the appearance and character of the neighborhood. i 2. In any residence district, roof -mounted accessory • antennas of any type may be erected on the roof of i the principal building to a maximum height of thirty-five feet (351) above the maximum height of 4 the building on which it is located. However, the W= 30-0-84 following additional requirements shall also apply to roof -mounted satellite earth stations: a. Only o.ne:asatellite earth stat�on.shall be permitted per lot. • b. Satellite earth stations shall not be visible between ground level and ten feet (10') above ground level from any street adjoining the lot. C. Satellite earth stations shall not exceed ten feet (10') in diameter. d. Satellite earth stations shall be neutral in color and, to the extent possible, compatible with the appearance and character of the neighborhood. 3. In any zoning district, except the B4 and B5 Business Districts, one permanent, extendable, - retractable .or telescoping ground -mounted tower, mast, or support, and accompanying antenna, that is accessory to a permitted or special use may be erected to a maximum height of seventy feet (701) above established grade, provided said antenna may only be located in a side or rear yard a minimum of ten feet (10') from any lot line. 4. In any residence district, one accessory ground -mounted satellite earth station may be erected to a maximum height of twelve feet (12') above adjacent ground level, provided: a. The diameter of such satellite earth station shall not exceed ten feet (10'). • b. Such satellite earth station may only be located in a rear yard, a maximum of ten feet (10') from any lot line. C. The satellite earth station shall be neutral in color and, to the extent possible, compatible in character and appearance with the surrounding neighborhood. 5. Ground -mounted satellite earth stations and microwave relay towers may be erected in manufacturing districts to the maximum building height applicable..in the underlying zoning district, provided: a.. They are not located between a building and a front lot 1 ine*. ' , r b. The visual impact of such satellite earth stations and.microwave relay towers is reduced by screening. C. If the subject parcel abuts a residence district, all such antennas shall be placed a minimum of ten feet (10') from any lot line and effectively screened by a solid fence, wall or dense screening • hedge to a minimum height of six W ). Said fence, wall or hedge shall be located on or near the lot line abutting the residence district and shall otherwise comply with the applicable zoning requirements governing its location. 9 -3- • • 30-0-84 d. The satellite earth station and microwave relay tower shall be neutral in color and, to the extent possible.; :compatible in appeararice.and character with the surrounding neighborhood. e. In Ml and M2 Manufacturing Districts, the maximum diameter of satellite earth stations shall not exceed ten feet (101). f. In all Manufacturing Districts, microwave relay antennas shall not exceed four feet (4') in diameter. 6. Antennas not complying with the requirements of this Section may be authorized only in accordance with the procedures for a special use. SECTION 3: That Section 6-3-6•-l(C) of the City Code of the City of Evanston, 1979, as amended, is hereby further amended to read as follows: (C) In any Yard in an M3 and M4 Restricted Manufacturing District Except a Required Yard and a Front Yard Other than Required (between a building and a front lot line): accessory satellite earth stations and accessory microwave relay antennas and their accompanying towers, masts, and supports. SECTION 4: That Section 6-3-6-1(D) of the City Code of the City of Evanston, 1979, as amended, is hereby further amended to read as follows: (D) In All Rear Yards and Side Yards, Except Required Side Yards: Private garages or carports, if attached or structurally part of the principal building, detached private garages, open accessory off-street parking spaces, carports, accessory sheds, tool rooms or other similar accessory buildings, open patios adjoining the prrincipal building which are not in excess of eighteen inches (18") in height, recreational equipment and facilities, laundry drying equipment, arbors, trellises, satellite earth stations, microwave relay antennas and supporting structures and -towers, masts, supports and accompanying antennas of other types. R SECTION 5: That Section 6-7-2-2, "R" of the City Code of the City of Evanston, 1979, as amended, is hereby further amended to read as follows: QC 30-0-84 R Resale shop for apparel and accessories, in B1, B2 and B3 Districts only. • Restaurants in B1 Business Districts only. • Retirement hotels, in B1, B2 and B3 Districts only. SECTION 6: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 7: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. Introduced: - W % , 1984.
