I! AN ORDINANCE
Granting a Special Use to Permit Con-
struction of a Drive-in Restaurant at
• 1901-11 Dempster Street

WHEREAS, the Evanston Zoning Board of Appeals
',conducted a public hearing on January 17, 1984 upon the
i,application of KFC National Management Co. (contract purchaser)
for a special use to permit construction of a drive-in
restaurant at 1901-11 Dempster Street, Evanston,.Illinois,
property located in an M3 Restricted Manufacturing District;
said hearing having been conducted pursuant to notice and
publication thereof in the manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said special use be granted,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the application of KFC Manage-
ment Co. (contract purchaser) for a
special use to permit construction of a drive-in restaurant on
property located at 1901-11 Dempster, Evanston, Illinois and
llegally described as:
A tract of land in the east 1/2 of the southwest 1/4 of
Section 13, Township 41, north, Range 13 east of the
third principal meridian, lying east of the easterly
right-of-way line of the -Chicago and North Western
Railway (formerly the Chicago Junction Railway),
bounded and described as follows: Beginning at the
intersection of the north line of Dempster Street
(being 33.00 feet north of the south line of said
Section 13), and the west line of Dodge Avenue (being
33.00 feet west of the east line of the said southwest
1/4 of Section 13); thence north 00' 00' 00" east along
the west line of Dodge Avenue (being also 33.00 feet
west of and parallel with the east line of said
southwest 1/4 of Section 13), a distance of 135.00
feet; thence south 87' 42' 20" west along a line
parallel with the south line of said Section 13, a
distance of 150.00 feet; thence south 000 00' 00" west,
a distance of 135.00 feet to a point on the north line
of said Dempster Street; thence north 870 42' 20" east
along the north line of said Dempster Street (being
also 33.00 feet north of and parallel with the south
line of said Section 13), a distance of 150.00 feet to
the point of beginning, all in the City of,Evanston,
County of Cook, State of Illinois

i is granted, subject to compliance with -all other provisions of
�{ the Zoning Ordinance, other applicable laws, and the following
conditions:
i
• (a) That the applicant shall take all necessary steps to
prevent vehicles entering or leaving the facility's
premises from stacking, double parking, or
obstructing the public right of way (street, parkway,
i or sidewalk) including, but not limited to, the
hiring of a security guard,•an off -duty policeman or
reimbursing the City, for the costs of stationing a
police officer at the premises to direct traffic. In
the event traffic problems arise the applicant agrees
to permit the installation of traffic signs
prohibiting left turns to vehicles entering or
{ leaving the premises;
(b) Within five (5) days of receipt of written notice of
violation of the provisions of this ordinance,
applicant shall initiate whatever steps it deems
effective to alleviate promptly any traffic problem
i and to that end applicant agrees to consult with the
City's Traffic Engineer; and
(c) That a covenant in recordable form be executed by the
applicant subscribing to the aforementioned terms and
conditions.
if SECTION 2: The Director of Building and Zoning
• {� is hereby directed to issue such .permit
II pursuant to the terms of this ordinance.
SECTION 3: This ordinance shall be in full force
I and effect from and after its passage and
