AN ORDINANCE
! Granting Release of Condition, Variations
and Special Uses from the Zoning Ordinance to
Permit Construction of Drive-in Facility
and -Parking Spaces at 1325-45 Howard Street

I WHEREAS, the Evanston Zoning Board of Appeals
!; conducted a public hearing on December 20, 1983 upon the
i
i!application oC..Gu.st-ave A. Prodromos as (1) president and sole
i
iishareholder of the Northfield Woods Water and Utility Co., sole
beneficiary under the Glenview State Bank & Trust Company Trust
11.52 of lot 1, and (2) president and sole shareholder of the
i Howard Northfield Building Corporation, owner of lot 2, for (a)
;release of certain conditions set forth in Ordinance 5-0-65;
(b) special uses to permit construction of a drive-in facility
!and installati.�n,.of parking spaces.; and (c) variations from
i;
j certain off-street parking regulations of the Zoning Ordinance,
I
all �I on,property located at 1325-45 Howard Street, Evanston, ,
'iIllinois; said hearing having been conducted pursuant to notice
and publication khereof in the manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said release, special uses and
ilvariations be granted;
NOW,.THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
�iTHE CITY OF EVANSTON; COOK COUNTY,.�LLINOIS:
SECTION 1: That 'the application of Gustave A.

;I at 1325-45 Howard Street, nvanston, Illinois, and legally
described as:
Lots-1 and 2 in the resubdivision of Lots 16 to 32, both

inclusive -,....in Arthur Dunas Howard Avenue Subdivision of
that part of the south half of the northeast quarter of
Section 25-, Township 41 North, Range 13 east of the Third
I� Principal meridian, lviha�south of the south line of the
north 45 acres thereof, and east of the east line of the
rest 6.358.acres of the east 16.358 acres of the south
• i 32.506 acres of said northeast quarter of said Section 25,
E in Cook Cetnty, Illinois
i` for certain special uses and variations from the Evanston
Zoning Ordinance is granted as follows:
A. Said property is.released from condition 2 of
Ordinance 570-65 and the covenant recorded as Document
19740838 with the Cook County Recorder of Deeds Office in
February, 1966, to wit:

ji "2. The westerly lot shall be used only for
purposes permitted under the present Zoning
O..Tdinance of the City of Evanston, which
(� 'classifies the subject property for R-6 General
Residence purposes, or for an office building,
Which may include offices for a savings and loan
association and for customary accessory uses, if
'y ;"such office or accessory uses should be granted
!i .by.. the City Council of the City of Evanston
!i :.,..Pursuant to application for a zoning amendment,
zoning variation, or special use permit."
�I B. A special use is granted to permit construction of a
• i drive-in facility for the savings and loan .facility on the
premises;
C. A special use is granted to permit installation of 19
of the proP4)sed 66 off-street parking spaces partially in
' the front yard and within twenty-five (25) feet of the
ii front lot line; and
D. Var_iations.are granted from off-street parking ~
regulations... -to permit (1 ) 66 off-street parking spaces to
serve thq•,e;aisting uses and proposed,drive-in facility
instead of the 74 spaces required; and (-2 ) no screening
of the parking area along the front line instead of the
4-foot-high. screening required,
said release,.special uses and variations are granted subject
to compliance-e-iIth all other provisions of the Zoning Ordinance
and other applicable laws.
SECT1011 2: The Director of building and
Zoning is hereby directed to issue such
permits as are required pursuant to the terms of this
. ordinance.
SECT IO14 3 : The City klanager or his
designee is authorized to execute a
'Release consistent with Paragraph A above.
SECTION 4: All ordinances or parts of ordinances
in conflict herewith are hereby. repealed.

and from and after its passage,
approval, and publication in the manner provided'by law.
