AN ORDINANCE
Granting a Variation and Permitting
Retention of a Beauty Parlor and Building
WHEREAS, the Evanston Zoning Board of Appeals
conducted public hearings on September 10 and October 15, 1985,
upon the application of Alvin E. Paden and Betty B. Paden for.'
variations from the use and non -conforming structure and use
regulations of the Zoning Ordinance to permit retention of the
beauty parlor use and retention of the front building on the
premises beyond the elimination date for said structure and use
of January 1, 1985 at.1025 Emerson Street, Evanston, Illinois,•
property located in an R.6 General Residence District; said
hearings having been conducted pursuant to notice and
publication thereof in the manner prescribed by law; and
WHEREAS, the City Council, based upon the transcript
of said hearings of the Zoning Board of Appeals and the hearing
and minutes of the Planning and Development Committee of
November 11, 1985, does find with respect to the application
for variations from the use and non -conforming structure and
use regulations of the Zoning Ordinance, as follows:
A. That a hardship will be imposed upon the
applicant by denial of this application and that such
hardship is not based solely upon the personal
financial situation of the applicant.
B. That there are unique circumstances with respect
r to subject property. That the property is located on
Emerson Street, a major thoroughfare in the city and
that across the street from the property is major
commercial and manufacturing development.
C. That the conditions set forth in paragraphs A and
B above are not the result of the applicant's
�• actions.
D. The application is not based solely upon
financial motivation.
E. That if the application for variations from the
Y use and non -conforming structure and use regulations
of the Zoning Ordinance is granted, there will not be
a change in the character of the locality;
F. That if the variations are granted, there will be
no depreciation in the value of adjacent property;

WHEREAS, based upon the recommendation of the
Planning and Development Committee that the application for
variations from the use and non -conforming structure and use
regulations of the Zoning Ordinance be granted,

I NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the application of Alvin
E. Paden and Betty B. Paden for
variations from the use and non -conforming structure and use
regulations of the Zoning Ordinance to permit retention of the
beauty parlor use and retention of the front building on the
premises beyond the elimination date for said structure and use ,
of January 1, 1985 on property located at 1025 Emerson,
Evanston, Illinois and legally described as follows:
That part of the Northwest quarter of the Northwest
quarter of Section 18, Township 41 North, Range 14,
East of the Third Principal Meridian, described as
follows: beginning on the South line of said tract
(being also center line of Emerson Street) at a point
348.5 ft. West of the West line of Maple Avenue;
thence North on a line parallel with the West line of,,.:
Maple Avenue 199.76 ft. to the South line of East and
West public alley which runs along the North side of
Lots 16 through 20 of County Clerk's Division in the
Northwest quarter of Section 18, aforesaid; thence
East on the South line of said alley 51.5 ft. to a
point 297 ft. West of the West line of Maple Avenue;
thence South 199.59 ft. on a line parallel with the
West line of Maple Avenue to a point on the center
line of Emerson Street 297 ft. West of the West line
of Maple Avenue; thence West along the center line of
Emerson Stret 51.5 ft. to the place of beginning
(except that part falling within Emerson Street);
also described as Lot 19 in County Clerk's Division
of unsubdivided lands in the Northwest quarter of
Section .18, Township 41 North, Range 14, East of the
Third Principal Meridian, (except that part of said
Lot falling within the East and West public alley
which runs along North side of said Lot), in Cook
County, Illinois,
is granted, subject to compliance with all other provisions of
the Zoning Ordinance and the condition that the variation
granted herein shall remain in effect only as long as said

building continues to be used for a beauty shop.
SECTION 2: The Director of Building and Zoning

j is hereby directed to issue such permits pursuant to the terms
of this ordinance.

SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
approval, and publication in the manner provided by law.
