HomeMy WebLinkAboutORDINANCES-1985-050-O-854/29/85 )'26/85 4/30/85 10/l/85 5/l/85. 10/2/85 8/6/85 • • • 50-0-85 AN ORDINANCE Amending Title 6 of the Evanston City Code Pertaining to Shelters for the Temporarily Homeless WHEREAS, the City Council of'the City of Evanston referred to the Zoning Amendment Committee a proposal to consider amending the Evanston Zoning Ordinance; and WHEREAS, the Zoning Amendment Committee conducted public hearings on December 27, 1984, February 7, 1985, March 7, 1985 and March 21, 1985 to consider said amendments to the Evanston Zoning Ordinance pursuant to publication in the manner prescribed by law; and WHEREAS, the Zoning Amendment Committee made recommendation to the City Council; and WHEREAS, on August 12, 1985, the City Council referred the matter of housing for the temporarily homeless to the Mayor's Special Committee .on the Homeless; and WHEREAS, The Mayor's Special Committee on the Homeless has conducted seven meetings and has recommended, ,based on evidence presented at -these meetings, consideration.of existing conditions, conservation of property values and the If direction of building development to the best advantage of the entire City that the Evanston Zoning Ordinance be amended; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 6-2-4 of the Evanston Zoning Ordinance, 1979, as amended, be and it is further amended by adding in proper alphabetical sequence the following definition: SHELTERS FOR THE A building, or portion thereof, TEMPORARILY HOMELESS in which sleeping accommodations on an emergency basis for the temporarily homeless are provided. SECTION 2: That Section 6-12-7, "SPECIAL USES," be and it is hereby further amended by f 50-0-85 adding subparagraph (F) to read as follows: (F) ADDITIONAL CONDITIONS AND STANDARDS FOR A SPECIAL USE FOR SHELTERS FOR THE TEMPORARILY HOMELESS: 1. Based on evidence presented by the applicant, the Zoning Board of Appeals shall find that (a) there exists a public need in Evanston for a shelter for • the temporarily homeless; and (b) the property line for the proposed shelter is not within 2500 feet of the property line of an existing shelter. The Zoning Board of Appeals shall further find the minimum number of beds which the applicant is to provide as a preference for homeless who have previously resided in Evanston. 2. Unless otherwise restricted by the special use permit, such restrictions, based upon the Zoning Board cf Appeals' determination of public need and other special use standards,.the maximum number of occupants permitted to remain in any such shelter shall be computed by dividing the square footage of habitable floor area by eighty (80) (resulting fractions shall be disregarded), but in no case shall exceed twenty (20) occupants (subject to requirements set forth in (F)l supra). 3. The special use authorizing a shelter for the temporarily homeless shall only be granted for a period of one year from the effective date of the ordinance authorizing such use. However, said special use may be further extended or modified for additional one-year periods by action of the Planning and Development Committee with the concurrence of the City Council. The property owner shall make written • .application to the Planning and Development Committee for such additional 1-year extensions. The Planning and Development Committee shall hold a public hearing on the extension. Said application and hearing shall be in the form and manner required by the Planning and Development Committee. SECTION 3: That Section 6-5-2, "R-1 SINGLE FAMILY RESIDENCE DISTRICT," of the Evanston Zoning Ordinance be and it is,hereby further amended by adding to subparagraph (B), "Special Uses," a new item 17 to read as follows: 17. Shelters for the temporarily homeless in lawfully established churches. SECTION 4: That Section 6-5-5, 11.R-5 GENERAL } RESIDENCE DISTRICT," of the Evanston Zoning Ordinance be and it is hereby further amended by adding to subparagraph (B), "Special Uses," a new item 17 to read as follows: 17. Shelters for the temporarily homeless in lawfully established churches. SECTION 5: That Section 6-5-7, "R-6 GENERAL EPAI 50-0-85 • • 4" �j RESIDENCE DISTRICT," of the Evanston Zoning Ordinance be and it is hereby further amended by adding to subparagraph (B), Special Uses, a new item 25 to read as follows: 25. Shelters for the temporarily homeless in lawfully established churches. SECTION 6: That Section 6-6-3(D), "SPECIAL USES," of the Evanston Zoning Ordinance be and it is hereby further amended by.adding to subparagraph (D)2, "U-2 and U-3 Districts," a new item to read as follows: 1. Shelters for the temporarily homeless in lawfully established churches. SECTION 7: That Section 6-6-4, "U=4 UNIVERSITY HOUSING DISTRICT," of the Evanston Zoning Ordinance be and it is hereby further amended by adding to subparagraph ('C), "Special Uses," a new item 10 to read as follows: 10. Shelters for the temporarily homeless in lawfully established churches. SECTION 8: That Section 6-6=6, "U-6 UNIVERSITY LAKEFRONT CAMPUS DISTRICT," of the Evanston Zoning Ordinance be and it is hereby amended by adding to subparagraph (C), "Special Uses.," a new item 10 to read as follows: 10. Shelters for thetemporarily homeless in_lawfully established -churches. SECTION 9: That Section 6-7-2, "BUSINESS DISTRICTS," of the Evanston Zoning Ordinance be and it is hereby amended by adding to 6-7-2-2, "Special Uses," a new item to read as follows: 9 Shelters for the temporarily homeless in lawfully established churches. SECTION 10: That Section 6-7-3, "COMMERCIAL DISTRICTS," of the Evanston Zoning Ordinance be and it is hereby further amended by adding to . 6-7-3-2(A), "Special Uses," a new item in "S" to read as follows: -3- { 50-0-85- z� Shelters for the temporarily homeless in lawfully ,i established churches. i' SECTION 11: This Ordinance shall be null and �i void one year from its date of passage .i iunles.s renewed by an affirmative vote of a majority of the ilcorporate authorities.
