AN ORDINANCE
Regulating the Presence
of Trespassers in Public School
Buildings and Grounds
BE IT ORDAINED BY THE CITY COUNCIL OF -THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Title 9 of the City Code
of the City of Evanston, 1979,
as amended, be and is further amended by adding the following
Chapter 12:

TRESPASSERS`IN PUBLIC SCHOOL +
BUILDINGS AND GROUNDS
SECTION:
9-12-1: Purpose
9-12-2: Definitions
9-12-3: Unlawful to Loiter
9-12-4: Penalty
9-12-5: Separability of Provisions
9-12-1: PURPOSE: To protect students and
employees of the Evanston public schools
against the nuisance and danger of trespassers as herein
defined, with the resulting detriment and danger to public
health and safety, the public interest,. convenience and
necessity requires the regulation of the use of public
school buildings and grounds and to that end the purposes
of this ordinance are specifically declared to be as
follows:
(a) To protect the people against the
unlawful activities of trespassers in public
school buildings and grounds, and
(b) To preserve to the people their con-
stitutional right to attend the schools of the
City of Evanston and use the public school
buildings and lands of the Evanston schools for
purposes appropriate thereto without harassment
or intimidation by trespassers.
• 9-12-2: DEFINITIONS: The following words, terms and
phrases when used in this ordinance have the meanings
ascribed to them in this section, except where the context

clearly indicates a different meaning.
Y
MINOR A person who has attained eleven (11)
years of age but who has not yet
reached eighteen (18) years of age.
NOTICE Within the meaning of this ordinance,
either personal notice, orally or in
• j writing, or if a printed or written
notice forbidding entry to an indivi-
dual or a group of which he/she is a
part, has been conspicuously posted or
exhibited at the main entrance to such
lands or buildings.

PUBLIC SCHOOL Any buildings, grounds, play area,
BUILDINGS AND parking lot, driveway, or athletic
GROUNDS field belonging to or under the
control and supervision of Evanston
Township High School District 202 or
Evanston School District 65.
TRESPASSER Any person who enters upon school
lands or in school buildings after
receiving notice that such entry is
forbidden, or remains upon such land
or in such building after receiving
notice -to depart.
Words singular in form include the
plural; any words plural in form in-
clude the singular; and words in the
masculine gender shall include the
feminine and neuter genders.
9-12-3: UNLAWFUL TO LOITER AND/OR TRESPASS: It shall
be unlawful for a person to loiter, idle,
wander, stroll, play or trespass in or about the public
school lands or buildings during the school year or
whenever school is in session or while school -sponsored
activities are taking place on school grounds if said
person is not enrolled in the public schools, is not
employed by the public schools, or has no bona fide
business with a student, employee, agent, or authorized
representative of the public schools.
9-12-4: PENALTY: Any minor violating the pro-
visions of Section 9-12-3 shall be dealt with
in accordance with the Juvenile Court law and procedure.
Any adult violating the provisions of 9-12-3 shall be
subject upon conviction of a fine of $500.00 per
violation.
9-12-5: SEPARABILITY OF PROVISIONS: It is the
intention of the City Council that each
separate provision of this ordinance shall be deemed
independent of all other provisions herein, and it is
„4; further the intention of the City Council that if any
provisions of this ordinance be declared invalid, all of the
• other provisions therein shall remain valid and enforceable.
SECTION 2: All ordinances or parts of ordinances

in conflict herewith are hereby repealed.

SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
approval, and publication in the manner provided by law.
