Granting a Variation for a
(� Restaurant at 525-27 Dempster Street

I� WHEREAS, the Evanston Zoning Board of Appeals

II conducted a public hearing on February 19, '1985.upon the
I� application of David Major as sole beneficiary under the Harris
Trust and Savings Bank, Trust 41798, and David Lipschutz
(lessee) for a variation from the off-street parking
I; regulations of the Zoning Ordinance to allow a change of use in
j a portion of the building to a fast-food restaurant without
�i supplying the net increase of three off-street parking spaces,
�i
! and a special use to allow establishment of a fast-food
i.
�I restaurant on the property located at,525-27 Dempster Street,
Evanston, Illinois, property located in a B2 Business District;
said hearing Having been conducted pursuant to notice and
publication thereof in the manner prescribed by law; and

II WHEREAS, the Zoning Board of Appeals has recommended
that the application for said variation and special use be
granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, ILLINOIS:
SECTION 1: That the application of David Major
as.sole beneficiary under the Harris
Trust and Savings Bank, Trust 41798, and David .Lipschutz

Ii(lessee) for a variation from the off-street parking,

regulations of the Zoning Ordinance to allow a change of use in
II a portion of the building to a restaurant without supplying the
required net increase of three off-street parking spaces on the
property located at 525-27 Dempster Street, Evanston, Illinois,
and legally described as follows:
Lot 10 in Block 38 in Original_ Village of
Evanston in Section 18, Township 41 North, Range

14, East of the Third Principal Meridian, in
Cook County, Illinois
is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the condition
• that the owner shall institute a litter prevention and litter
•

clean-up program acceptable to the City.
SECTION 2: The applicant shall maintain a prominently
displayed sign at the entranceway(s) to
the restaurant encouraging patrons to park west of the alleyway,
away from the residential -area. The applicant shall work with
the City Manager to develop programs that will avoid creation of
nuisances.
SECTION 3: That the application of David Major as
sole beneficiary under the Harris Trust and
Savings Bank, Trust 41798, and David Lipschutz (lessee) for a
special use to allow the establishment of a fast-food restaurant
on the property located at 525-27 Dempster Street, Evanston,
Illinois, is denied.
SECTION 4: The Director. of Building and Zoning
is hereby directed to issue such permits
pursuant to the terms of this ordinance.
SECTION 5: This ordinance shall be in full force and
effect from and after its passage and
approval in the manner provided by law.
