HomeMy WebLinkAboutORDINANCES-1985-009-O-8512/12/84 1/16/85 9-0-85 W AN ORDINANCE Amending Section 9-4-3 of the Evanston City Code, 1979, as Amended, Pertaining to the Number of Dogs That Occupy a Premises BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 9-4-3 of the City Code of the City of Evanston, 1979, as amended, pertaining to licensing of dogs and other animals, be and hereby is amended as follows: 9-4-3: LICENSE PROVISIONS: (A) Required; Due Date: No person shall, without first obtaining a permit therefor in writing from the Finance Director, own, keep, harbor or have custody of any animal over four (4) months of age; provided, however, that nothing contained herein shall be construed to require the owners of small cage birds, aquatic and amphibian animals, small cage rodents or nonpoisonous snakes less than three feet W ) in length, which are kept solely as pets, to obtain such permit. Such license shall be obtained on or before May 1 in each year, except for an animal less than four (4) months old on that day, in which case a • license shall be procured when the animal attains that age. i (B) Limitation on Number of Dogs: The occupancy of any premises by more than 3_ dogs, whether licensed or unlicensed, shall be prohibited. Said prohibition shall not include dogs less than four (4) months of age. Exempted from this limitation are those commercial uses, specifically authorized elsewhere in the City Code, for which occupancy by dogs is customary (such as, but not limited to kennels, pet shops and veterinarians). (C) Administration: The Finance Director shall promulgate regulations governing the issuance of permits and for compliance with all provisions of this Chapter and other applicable state and local laws. (D) Application; Requirements: At the time of making application for an animal permit, the owner shall furnish the following information and material to the Finance Director: 1. The name and address of the owner of the animal—]1j. 2. The sex and breed of the animal. i 3. A certificate of inoculation against rabies issued by the county Rabies Inspector, his deputy or a licensed veterinarian bearing proof that such inoculation shall be effective throughout the full license period, shall be submitted to the Finance Director for his inspection. 4. The name and address of the issuer of the certificate of inoculation. 9-0-85 • • 5. The number of other dogs, if any, occupying and/or licensed for the same premises as applicant. (E) Period of Validity; Transferral: A permit, if not revoked, shall be valid until the last day of April following the date of issuance. A new permit shall be obtained each year by every owner and a new fee paid. If there is a change in ownership of an animal or facility, the new owner may have the current license transferred to his name upon payment of a one dollar ($1.00) transfer fee. (F) Tag: Upon issuing a permit to keep any animal, the Finance Director shall issue to the owner a durable tag or identification collar, stamped with an identifying number and with the year of issuance. Tags should be so designed that they may conveniently be fastened to the animal's collar or harness. Animals must wear identification tags or collars at all times when they are off the premises of the owner. The Finance Director shall maintain a record of the identifying numbers and shall make this record available to the public. (G) Revocation: The Finance Director, after convening an administrative hearing, may revoke any permit if the person holding the permit refuses or fails to comply with this Chapter, the regulations promulgated by the Director, or any State or local law governing cruelty to animals or the keeping of animals. Any person whose permit is revoked shall, within ten (10) days thereafter, humanely dispose of all animals being owned, kept or harbored by such person and no part of the permit fee shall be refunded. It shall be a condition of the issuance of any permit to any owner of animals kept for commercial purposes that the Animal Control Warden or veterinarian acting for the City shall be permitted to inspect all animals and the premises where animals are kept at any time and the Finance Director shall, if permission for such inspections is refused, revoke the permit of the refusing owner. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
