AN ORDINANCE
Granting a Variation at 1900-80 Dempster
WHEREAS, the Evanston Board of Appeals conducted
• (public hearings on July.15, 1986, August 19, 1986 and September
16, 1986 upon the application of Banbury/Evanston Limited
Partnership as beneficiary under the LaSalle National Bank of
Chicago, Trust No. 109877 for a variation from the permitted
use regulations of the Zoning Ordinance to permit the
construction of a fast-food restaurant on the space depicted on
the site plan as number 129 at 1900-80 Dempster Street,
!Evanston, Illinois, property located in an M3 Restricted
I
(Manufacturing District; said hearing having been conducted
'pursuant to notice and publication thereof in the manner
;prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said variation be granted,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
• 1THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the application of Banbury/Evanston
Limited Partnership as beneficiary under the LaSalle National

Bank, Trust No. 109877 for a variation from the permitted use
regulations of the Zoning Ordinance to permit the construction
of a fast-food restaurant on the space depicted on the site
plan as number 129, on the property located at 1900-80 Dempster

Street, Evanston, Illinois, and legally described as follows:
Lot 1 in Banbury Consolidation of lots and parts and
vacated streets and alleys in Grover and Pitner's Addition
to Evanston being a Subdivision of the Southwest 1/4 of
the Northeast 1/4 of the Northwest 1/4 of Section 24,
i Township 41 North, Range 13, in Pitner's Third Addition to
Evanston being a Subdivision of the Southeast 1/4 of the
Northeast 1/4 of the Northwest 1/4 of Section 24, Township
41 North, Range 13, also the Chicago and North Western
Transportation Company Right of Way in the Northeast 1/4
of the Northwest 1/4 of said Section 24; together with
• part of the North 1/2 of the Northeast 1/4 of the
Northwest 1/4 of Section 24, Township Al North, Range 13,
East of the Third Principal Meridian, also providing for a
certain street dedication, in Cook County, Illinois
is granted, subject to compliance with all other provisions of
the zoning Ordinance, other applicable laws and the following

conditions:

1. A majority of the foods sold by the subject fast-food
restaurant shall be consumed within the establishment
and for the purposes of this condition, such
determination shall be based on the dollar volume of
i food and beverages sold by the establishment compared
with the dollar volume of food sold for consumption
• within the establishment;
2. The City shall be provided with the sales figures or
other data as may be deemed necessary by the Director
of Building and Zoning and shall also be allowed to
inspect the premises in order to determine compliance
with the preceding condition;
3. Trash receptacles shall be placed at the exits from
the parking area serving the outlot on which the
proposed fast-food restaurant will be located and the
City shall permit the operator/owner to post a sign
or signs describing the City Ordinance applying to
litter at the entrances to the parking area for the
outlot and the entrances to the shopping center as a
whole;
4. The hours of operation of the subject fast-food
restaurant shall be limited to 1.0:00 A.M.-to 11:00
P.M. Sunday to Thursday,, 10:00 A.M. Friday to 1:00
A.M. Saturday, and 10:00 A.M. Saturday to 1:00 A.M.
Sunday;
5. The hours of operation stipulated herein in condition
number four (4) shall be subject to review by the
City Council after the subject fast-food restaurant
has been open and operating for at least twelve
• months; and if a modification in said hours appears
appropriate to the City Council it shall refer the
matter to the Zoning Board of Appeals for a hearing
` and their recommendation regarding hours of
operation;
6. The owner/operator shall be responsible for litter
pickup within a one hundred fifty foot (150) radius
of the subject property.
7. A covenant of agreement to the above terms and
conditions shall be prepared by the applicant,
reviewed by the Law Department of the City and upon
approval, shall be executed and recorded by the
applicant with a copy of said recorded covenant
furnished to the Law Department of the City and the
Department of Building and Zoning.
SECTION 2: The Director of Building & Zoning is
hereby directed to issue such permits
pursuant to the terms of this ordinance.
SECTION 3: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
• SECTION 4: This ordinance shall be in full force
and effect from and after its passage,
