North Shore Pizza, i Inc., prospective tenant, for a variation from the permitted use regulations of the Zoning Ordinance to permit establishment of a fast-food restaurant in a proposed building located at 1 11 3325-33 Simpson Street, Evanston, Illinois, and legally , f; described as follows: Lots 8, 9 and 10 (except the West 10.0 Feet thereof) in Block 4 in the.Highlands Evanston Lincolnwood First �j Addition, being a subdivision of the Southwest 1/4 of the i� Southwest 1/4 (except the West 20 Acres thereof) of j Section 11, Township 41 North, Range 13, East of the Third i� Principal Meridian, in Cook County, Illinois „ �) is granted, subject to compliance with all other applicable provisions of the Zoning Ordinance of the City Code and the following conditions: -l- i 99-0-86 f� 1. No more than 20% of the food prepared by the i fast-food restaurant shall be sold to persons who; drive to the premises or who come to the premises to pick up food, and no food shall be served for consumption on the premises; , I 2. no frying or deep fat frying of food shall be • �; conducted on the premises; 3. the City shall be provided with such sales figures or 11 other data as may be deemed necessary by the Director' of Building and Zoning to monitor compliance with thel conditions imposed in connection with this case; 4. all exhaust vents and air conditioning units serving i the entire development shall be located on the roof ,• and no exhaust vents or air conditioning units.shall i; vent toward the residential areas; .I 5. food shall not be sold for consumption in the parking area; i 6. delivery vehicles of the fast-food restaurant shall i not exceed a gross vehicle weight of 4,000 pounds; 7. the premises shall not be used for carry -out as i opposed to delivery by employees later than 11:00 p.m. 8. the hours of operation of the subject fast-food i restaurant shall be limited to 10:00 a.m. to 11:00 p.m., Sunday to Thursday; 10:00 a.m., Friday to 1:00 a.m., Saturday; and 10:00 a.m., Saturday to 1:00 t a.m., Sunday; 9. the hours of operation stipulated herein i.n'condition! • number eight (8) shall be subject to review by the I City Council after the subject fast-food restaurant has been open and operating for at least six (6) months and in connection with said review by the City, Council, the Director of Building and Zoning shall supply a report on the impact of the stipulated hours of operation on the surrounding neighborhood and if a, modification in said hours of operation appears appropriate to the City Council, it shall refer the matter to the Zoning Board of Appeals for a hearing and their recommendation regarding hours of operation; ;f 10. the use shall be consistent with the application and testimony submitted in connection with this case; except that cooking shall be permitted on the i premises. f SECTION 2: The Director of Building and Zoning is hereby directed to issue such permit pursuant to the terms of this -ordinance.
