AN ORDINANCE Amending Section 9-5-23(A) of the Evanston City Code Pertaining to Noises Prohibited • WHEREAS, Title 9, Chapter 5, Section 23 of the I Evanston City Code declares certain acts as'loud, disturbing and unnecessary; and WHEREAS, the City Council of the City of Evanston finds that the use of motor vehicle alarms has increased as well as the number of such alarms.which are triggered; and WHEREAS, there has been an unacceptable increase in loud, disturbing and unnecessary noise in the City of Evanston due to triggered motor vehicle alarms, and.that such noise constitutes a nuisance; and t WHEREAS, the City Council of the City of Evanston has determined that this noise must be discouraged and abated in order to protect the health, safety and welfare of the citizenry and preserve the peace and quiet of the community; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 9-5-23(A) of the City Code of the City of Evanston, 1979, as amended, be and hereby is amended by the addition of a new ' subparagraph 5 to read as follows: 5. Motor Vehicle Alarms: The use of a continuous, audible signal device which acts as a vehicle burglar alarm, when such device is not limited in operation to ten (10) minutes after activation, and is capable of further activation without being reset to become active again. In addition to the general penalty provided in Section 1-4-1 of the Evanston City Code, any E violation of 9-5-23(A)5 will automatically give the Evanston Police Department the authority to take reasonable measures to abate the noise or tow the vehicle to a City vehicle pound, and impose towing charges which shall be paid by the registered owner i • of the vehicle. Owners who violate this Ordinance shall assume the risk of any damage which may be caused by efforts of the City to abate the nuisance. i SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. i i 66-0-86 SECTION 3: This ordinance shall be in full force i and effect from and after its passage, approval, and publication in the manner provided by law.
