HomeMy WebLinkAboutORDINANCES-1986-049-O-865/6/86' 5/13/86 5/7/86 5/20/86 5/9/86 • 49-0-86 AN ORDINANCE Amending Title 6 of the Evanston City Code Pertaining to Shelters for the Homeless and Providing an Exemption for Certain Shelters 3 WHEREAS, the Evanston Zoning Amendment Committee conducted public hearings on March 6, March 20 and April 17, 1986 on a reference from the City Council to (1) exempt from the provisions otherwise imposed by Ordinance 50-0-85 any shelters for the temporarily homeless now in existence and' recognized by the City Council as of October 31, 1985; and (2) authorize shelters for the temporarily homeless as permitted or special uses in buildings other than churches in all zoning , districts, said public hearings having been conducted pursuant to notice and publication thereof in the manner provided by law; and WHEREAS, the Zoning Amendment Committee has ; recommended, based on evidence presented at those public hearings, findings of fact, consideration of existing i conditions, conservation of property values and the direction of building development to the best advantage of the entire city, that the Evanston Zoning Ordinance be amended to authorize shelters for the temporarily homeless as special uses in certain zoning districts; and WHEREAS, the Zoning Amendment Committee has recommended that any shelters for the temporarily homeless now in existence and recognized by the City Council as of October 31, 1985, not be exempted from special use provisions of Ordinance 50-0-85; and WHEREAS, the Zoning Amendment Committee did find that the City Council may consider alternative ways to accomplish I said exemption and among those ways the Zoning Amendment Committee proposed that the City Council enact zoning amendments necessary to exempt any shelter for the temporarily homeless now in existence and recognized by the City Council as ' 49-0-86 i of October 31, 1985 from the provisions imposed by said Ordinance 50-0-85; and WHEREAS, the Planning and Development Committee, at i public meetings conducted on April 28, May 5, May 12 and May 19, 1986, did consider the Zoning Amendment Committee Report (ZAC 86-1) on said reference; and 9 WHEREAS, the Planning and Development Committee has i i recommended, based on the report and transcript of the Zoning � Amendment Committee, based on the evidence presented at said i ZAC public hearings, and based on the evidence presented at said Planning and Development Committee meetings, the findings of fact made by the Zoning Amendment Committee, consideration E of existing conditions, conservation of property values, the direction of building development to the best advantage of the i entire city: i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: j SECTION 1: That Section 6-5-5(B) 17 of the Evanston City Code, 1979, as amended, be and hereby is amended to read as follows: 1 17. Shelters for the temporarily homeless. i SECTION 2: That Section 6-.5-7(B)25 of the Evanston City Code be and hereby is amended to read as follows: 25. Shelters for the temporarily homeless. SECTION 3: That Section 6-6-3(D)1 of the Evanston City Code be and hereby is i amended by adding the following as subsection b: b. Shelters for the temporarily homeless. SECTION 4: That Section 6-6-3(D)2; Subsection 1 of the Evanston City Code by and hereby is amended to read as follows: i 1. Shelters for the temporarily homeless. SECTION 8: That Section 6-7-3-2"S" of the Evanston City Code be and hereby is I; li amended to read as follows: I I S Shelters for the temporarily homeless provided that in C2 and C3 Districts such shelters may only be located in lawfully established churches. Shops for repair of furniture, appliances and office equipment. Shops for soldering and welding. j Sign painting. i Signs, advertising and ground, more than one hundred fifty (150) square feet in gross surface area, subject to the conditions and restrictions on all signs established in this Section. Storage and warehousing establishments for household and office goods and retail merchandise. SECTION 9: That the shelter for the temporarily homeless now in existence at First Baptist Church at 607 Lake Street, and recognized by the City i Council as of October 31, 1985 is exempt from the provisions of i Ordinance 50-0-85 for the period of one year commencing on October 31, 1985 and upon the following conditions: 1. The Planning and Development Committee with the j concurrence of'the City Council may extend or modify for additional one-year periods the aforesaid exemption. The Planning and'Development Committee shall hold a public hearing to consider said one-year extensions. The hearing shall be in the form and manner required by the Planning and Development j Committee. -3- B • 1 : • 2. That based on evidence of significant need presented at said public hearing, the Planning and Development Committee, with the concurrence of the City Council, .may permit the resident population of said shelter to exceed twenty (20) inhabitants but in no case shall exceed thirty (30) inhabitants, during the period November 1 through May 31 of the calendar year. 3. That during the period June 1 through October 31 of the calendar year the resident population of said shelter shall not exceed twenty (20) inhabitants. 4. Said shelter shall provide a preference for homeless applicants who have previously resided in Evanston. 5. "That said shelter shall also comply with all licensing requirements established by Ordinance 51-0-85 which are not in conflict with this exemption. SECTION 10: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 11: This ordinance shall be in full force and effect from and after its passage, approval, and publication.in the manner provided by law.
