AN ORDINANCE
Regulating Certain Uses of Merrick Park
by Issuance of Special Park Permits
WHEREAS, the City Council of the City of Evanston
VPrecognizes that Merrick Park, the Municipal Rose Garden located
at Oak Avenue and Lake Street in Evanston, has long been

.visually appreciated and utilized for passive recreational
enjoyment by the citizens of Evanston and the general public
i and should continue to be available for such uses; and
WHEREAS, the City Council of the City of Evanston is
aware of the many significant horticultural awards bestowed
upon the City as a. tribute to Merrick Park's aesthetic beauty;
and
WHEREAS, the City Council of the City of Evanston is
further aware of the increasing demands for use of Merrick Park
for special events and ceremonies; and
WHEREAS, the City Council of the City of Evanston
believes that these special uses, while not inconsistent with
park purposes and the public interest, must nevertheless be
regulated to avoid interference with the Evanston community's
continued viewing, and enjoyment of the Park;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Title 7, Chapter 10 of the City
Code of t.he.City of Evanston, 1979, as
amended, be further amended by the addition of a new Section
7-10-5 entitled MERRICK PARK REGULATIONS, to read as follows:
7-10-5: MERRICK PARK (MUNICIPAL ROSE GARDEN)
REGULATIONS:
(A) Permits: Use of the Park for a special event or
ceremony shall be by permit only. Any party desiring
a permit shall apply in writing to the City's
Department of Parks on forms provided by said
Department. Permits are issued at the discretion of
thE! Department and are subject to the following
minimum conditions:
1. Permits are available only for Saturday, Sunday
and holidays. Only one permit may be issued for any
day, and will specify the hours allowed for the
special use.
2. Permit fee is Fifty Dollars ($50.00); required
security deposit is Cne Hundred Dollars ($100.00),

both fees to be paid upon permit approval and prior,
to issuance. Security deposit will be returned
following inspection of premises by City, provided
that no damage has occurred. If permit holder or
agents have caused damage to the Park, the security
deposit shall be withheld to cover the cost of
repair. Costs exceeding One Hundred Dollars
($100.00) shall be borne by permit holder. The Fifty
• Dollar ($50.00) permit fee is refundable only if
approved reservation is cancelled at least one week
prior to permit date.
3. Permit holders shall limit attendance to the
number of persons authorized by the Department of
Parks.

4. Permit holders shall be required to provide
insurance naming the City as an additional insured in
an amount and form approved by the City.
5. Permits shall entitle permit holders to exclusive
use by their groups of only the central recessed lawn
area of the Park.
6. Additional Rules and Regulations: The Director
of the Department -of Parks, Recreation and Forestry
or his/her designee may promulgate additional rules
and regulations for permit holders and the general
public as are deemed necessary to preserve and
protect the park area and promote the intended use of
the Park.
(B) Prohibited Activities: It shall be unlawful for any
person, including any permit holder, to place any
tents, platforms, sound transmission devices, or
similar obstructions in the Garden; to serve or
consume any food or beverage in the park; to remove
any horticultural growth or materials of any City
property from the Park; to violate the hours of
operation;
(C) Hours of Operation: The Park shall be open during
hours specified in Section 7-10-2(B) of the City
Code.
SECTION 2: The Department of Parks shall,
within six (6) months of the passage of
this Ordinance, present a status report to the City Council
setting forth information regarding the number of applicants, ;
the number of permits issued and the nature of the events, the
fees collected, the type of insurance provided and any other ,
data necessary to determine the impact of this Ordinance on the
use of.the Park and on the community.
SECTION.3: All ordinances or parts of ordinances
0 in conflict herewith are hereby repealed.
SECTION 4: This ordinance shall be in full force
and effect from and after its passage,
