HomeMy WebLinkAboutORDINANCES-1987-112-O-87E 10/22/87 112-0-87 AN ORDINANCE Amending Certain Provisions in Ordinance 49-0-86 Pertaining to Maximum Occupancy of the Shelter for the Temporarily Homeless WHEREAS, the City Council of the City of Evanston adopted Ordinance 49-0-86 on May 19, 1986, pertaining to shelters for the homeless; and WHEREAS, Section 9 of said Ordinance provided for the exemption of the shelter for the temporarily homeless located at First Baptist Church at 607 Lake Street from the provisions imposed by Ordinance 50-0-85 which would otherwise require the i !approval of said shelter through the special use process; and WHEREAS, the Planning and Development Committee i conducted a hearing on October 12, 1987 in accordance with the �a 1provisions of Ordinance 49-0-86, to consider extending the laforesaid exemption and said exemption was extended with the ;.concurrence of the City Council for an additional one-year li is • ;1period on October 26, 1987 by a vote of the Council; and ij WHEREAS, in connection with said exemption the Planning and Development Committee and the City Council desire to increase the maximum allowable resident population of said shelter to thirty (30) inhabitants on a year-round basis; and WHEREAS, said resident population increase requires !Ian amendment to Section 9 of Ordinance 49-0-86; �i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 9 of Ordinance 49-0-86 I! which .creates an exemption from the I� provisions of Ordinance 50-0-85 for the shelter for the { i J�temporarily homeless at First Baptist Church at 607 'Lake Street and imposes certain conditions thereon is hereby amended to • read as follows: ii i; I } M.r+i. �w1ai ,,.,ati+,�,wr^,> s�..,.��;�r, yS�`i.kx,'�I..a:r,y e :. _ .+F;• +ykipa�f%�".j�iii{5;;. !{, i. :`,4g , I ,si4�:�» w.�..�ft ��ww,aa. •; a{�''s �,r-, 112-0-87 • • SECTION 9: That the shelter for the temporarily homeless now in existence at First Baptist Church at 607 Lake Street, and recognized by the City Council as of October 31, 1985 is exempt from the provisions of Ordinance 50-0-85 for the period of one year commencing on October 31, 1985 and upon the following conditions: 1. The Planning and Development Committee with the concurrence of the City Council may extend or modify for additional one-year periods the aforesaid exemption. The Planning and Development Committee shall hold a public hearing to consider said one-year extensions. The hearing shall be in the form and manner required by the Planning and Development Committee. 2. That based on evidence of significant need presented at said public hearing, the Planning and Development Committee, with the concurrence of the City Council, may permit the resident population of said shelter to exceed twenty (20) inhabitants but in no case shall it -exceed thirty (30) inhabitants. 3. Said shelter shall provide a preference for homeless applicants who have previously resided in Evanston. 4. That said shelter shall also comply with all licensing requirements established by Ordinance 51-0-85 which are not in conflict with this exemption. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. Introduced I Adopted: i •i I' II ATTEST: 1987.
