National Fire Prevention Code, 1987 Edition, and Appendixes A, B, C and NFPA 101.76 as the Fire Prevention Code of the City of Evanston WHEREAS, the City Council of the City of Evanston considers it in the public interest to adopt as its standard for o construction, alteration, and installation permits and general fire protection the BOCA National Fire.Prevention Code, Seventh Edition, 1987. WHEREAS, the City Council of the City of Evanston has caused three (3) copies of the aforesaid Code to be kept on file in the office of the City Clerk for public inspection for a period of more than thirty (30) days prior to the adoption of this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1':. That Sections 4-5-1 and 4-5-2 of the Code of the City of Evanston, 1979, as amended, be further amended to read as follows: 4-5-1: ADOPTION OF THE BUILDING OFFICIALS AND CODE ADMINISTRATORS INTERNATIONAL, INC.'S BASIC NATIONAL FIRE PREVENTION CODE OF 1987: The City of Evanston hereby adopts by reference thereto the Building Officials and Code Administrators International, Inc. (BOCA) Basic National Fire Prevention Code of 1987 and Articles 1 through 34 and Appendixes A, B, C and NFPA 101.76 thereof as criteria for the. - control and regulation of conditions which would constitute fire hazards to persons or property within the City or which would interfere with fire suppression forces, excepting therefrom the following sections which are modified to read as follows: SECTION 2: That Sections 4-5-2 and F105.3 of the Code of the City of Evanston, 1979, as amended, be further amended to read as follows: 4-5-2: MODIFICATIONS TO THE CODE: The following sections of the hereinabove adopted Fire Prevention Code are modified in the following respects: F105.3. Inspections and Unsafe Buildings: The fire of- ficial shall inspect or cause to be inspected all buildings and premises authorized by this code, including the situs of potential hazards and appli- ances for the purpose of ascertaining and causing to be corrected any condition which may be reason- ably foreseen to be a fire or explosive hazard or interfere with the suppression of fire or abating of a public emergency, or which constitutes a vio- lation of the provisions of this code and any other law or standard affecting life safety. All build- ings or structures which are structurally unsafe or not provided with adequate egress, or Which consti- tute a fire hazard, or are otherwise dangerous to human live, or which in relation to existing use constitute a hazard to safety, or health, or public welfare, by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard, disaster damage, or abandonment, as specified in the 1987 BOCA National Fire Prevention Code or any other effective ordinance,'are for the purposes .of this section, unsafe buildings. All such unsafe buildings are hereby declared to be public nuisances and shall be abated, by repair, rehabilitation, demolition, or removal in accordance with procedures provided by law. SECTION 3: That Section 4-5-2 of the Code of the City of Evanston, 1979, as amended, be further amended to read as follows: F101.4. Existing Buildings: Buildings built under, and in full compliance with, the codes in force at the time of construction or alteration thereof, and that have been properly maintained and used for such use as originally permitted, shall be exempt from the requirements of this code pertaining to: 1. Fire protection of structural elements except • as provided for existing buildings under the building code. 2. Exits required, except as provided for existing buildings under this code and the building code; and 3. Isolation of hazardous operations; provided, however, that the fire official may require the in- stallation of fire safety devices or systems (fire extinguishers; fire alarms,'fire detection devices, sprinklers or similar systems) where, in accordance with prevailing fire safety standards, as adopted by this code, they are necessary to provide safety to life and property. In.lieu of requiring the in- stallation of safety devices or systems, or when necessary to secure safety in addition thereto, the fire official may prescribe limitations on the handling and storage of materials or substances or upon operations that are liable to cause fire, contribute to the spread of fire, or endanger life or property. F102.2. Inspections: The fire official or other designated inspector of the Fire Department upon the complaint of any person or whenever he shall deem it neces- sary shall inspect all structures and premises ex- cept single family dwellings and dwelling units in two family and multi -family dwellings for the pur- pose of ascertaining and causing to be corrected any condition liable to cause fire, contribute to the spread of fire, interfere with firefighting operations, endanger life, or any violation of the provisions or intent of this code and ordinance and any other law or standard affecting life safety from fire. F301.0 Open burning: No open fires are allowed. No person shall burn leaves or other refuse in an open fire. Open fires which are used primarily for cooking food at public and private gatherings are permitted. All open fires primarily used for organizational purposes, (i.e. scout groups, neighborhood groups, etc.) shall meet the "Rules for Organizational Fires" as established and promulgated by the Fire Department of the City and application shall be made for a permit to the Fire Chief. Only those open fire organizational applications meeting the requirements of the "Rules for Organizational Fires," shall receive a permit. F404.4 Smoke Detectors 1. Use Group R1 and Dormitories: All existing residential uses as defined by the building code listed in Appendix A, Use Group R-1 and also all • existing dormitory buildings arranged for the shel- ter and sleeping accommodations of'more than 20 persons shall be provided with a fire and smoke alarm system as approved by the fire official and installed in accordance with nationally recognized standards listed in Appendix A. When activated manually or automatically the Fire and Smoke Alarm systemshall provide an audible alarm throughout the building. -2- 2. Single Family, Multi -Family, Kited Use: (a) Every dwelling unit in a single family, multi -family or mixed use building shall be._. equipped with at least -one (1) approved smoke detector of the ionization.or-photoelectric-type in - an operating -condition within 15-feet of every room used for sleeping purposes. The detector shall be installed on the ceiling and -at least 6 inches from any wall,.or-a wall located between 4 and 6 inches from the ceiling.- -- (b) Every single family residence shall have at least one.-(1) approved smoke detector installed -on- .'- every story of -the dwelling unit, including base- ments but not including unoccupied attics: In dwelling units with split levels, a smoke detector installed--on:,the upper level shall suffice for -.the - adjacent lower -level if the lower level is less *- than one (1)'full-story below the upper level; how- ever, if -there is an intervening door between the adjacent levels, --a smoke detector shall- be in- stalled on each level: (c) Every structure which (1) contains more than one dwelling unit, or (2)-contains at least one dwelling unit and is.i .a--mred-use structure, shall contain at least one approved smoke -detector at the uppermost -ceiling .of each interior stairwell. The --..- detector shall be installed -on -the ceiling, -at-.,--. least- 6- inches from the -wall, or on -a-'-wall.,. located between- 4 and- 6- inches, from the ceiling.... (d) ---It shall be the responsibility of the owner -of .;. a structure to supply and install all required de tectors. The owner shall -be -responsible for making reasonable efforts to test and -maintain detectors = in common stairwells and hallwaps._..-It shall be the responsibility of- a tenant.to-test and to provide general maintenance for -.the --detectors within the tenants dwelling -unit or rooming unit, and to - notify the owner -or the authorized agent of the - owner in writing of any -deficiencies which the - tenant cannot correct. The owner shall -be respon- sible for providing one tenant per dwelling unit with written information regarding detector testing and maintenance. --- The tenant shall be responsible for replacement of any required -batteries in the smoke detectors in the tenant's dwelling unit, except -that -the owner shall -insure --that such batteries -.are -in operating condition-at,the-time the tenant takes possession of the dwelling -unit. ---The tenant shall.provide the owner or the authorized agent of the owner -with - access to the dwelling unit -to correct -any defi- ciencies -in the smoke detector.which have been re- ported in writing to the owner or the -authorized _ agent of the owner. (e) The requirements of this Section -shall apply to any dwelling unit in existence --on the effective date of- this Ordinance. The smoke detectors re- -- quired in such dwelling units may be either.battery powered or wired into the structure's-A.C.-power line, and need not be interconnected. - (f) Compliance with an applicable Federal,.State or local law or building code which requires the - installation and maintenance of smoke detectors in -3- a manner different from this Section, but providing a level of safety for occupants which is equal to or greater than that provided by this Section, shall be deemed to be in compliance with this Section, and the requirements of such more strigent law shall govern over the requirements of this Section. F 405.1 All new elevators and existing elevators undergoing major alteration shall conform to the requirements of the American National Standard Institute ANSI/ASME A 17.1, 1981 Safety Code for Elevators and Escalators published by the American Society of Mechanical Engineers. SECTION 2: All ordinances or parts of ordinances in con- flict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and ef- fect from and after its passage, approval, and publication in the manner provided by law.
