Adopting the National Electrical Code, 1987
by Reference and Amending Title 4, Chapter 7,
Sections 1-4 and Section 9 of the City Code
of the City of Evanston

WHEREAS, the City Council of the City of Evanston has
caused three (3) copies of the aforesaid Code to be kept on file in the of-
fice of the City Clerk for public inspection for a period of more than thir-
ty (30) days prior to the adoption of this ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EVANSTON, COOK COUNTY, ILLINOIS: . .
SECTION 1: That Sections 4-7-1, 4-7-2, and 4-7-3(A) of the
City Code of the City of Evanston, 1979, as
amended, are further amended as follows:
4-7-1: ADOPTION OF NATIONAL ELECTRICAL CODE:
Pursuant to authority granted by Chapter 24, Section
1-2-4, Illinois Revised Statutes, and pursuant to its home rule pow-
ers, the City of Evanston hereby adopts, by reference, as criteria for
the issuance of construction, reconstruction, alteration or installa-
tion permits, the provisions of the National Electrical Code, 1987
Edition.
4-7-2: APPLICATION OF REGULATIONS: The regulations of the
National Electrical Code, 1987 Edition, shall apply to all
matters concerning the construction, reconstruction, alteration or in-
stallation of all electrical wiring apparatus, fixtures, machinery or
devices, and their service equipment, and shall apply to all existing
or proposed buildings and structures in the City.
4-7-3(A): AMENDMENTS AND EXCEPTIONS TO THE CODE: The following
sections of the National Electrical Code, 1987 Edition,
are amended to read as'follows:
A. Chapter 3, Article 338 of the 1987 Code shall be
deleted in its entirety.
B. Article 680-D of the 1987 Code shall be titled Spas,
Hot Tubs and Hydro Massage Tubs.
SECTION 2: That Sections 4-7-8 and 4-7-9 of the City Code of
the City of Evanston, 1979, as amended, are
further amended as follows:
4-7-8: ELECTRICAL CONTRACTORS
(A) Definition: The term "electrical contractor" as used in this
Section, means any person, firm.or corporation engaged in the
l!i business of installing or altering by contract electrical
equipment for the utilization of electricity for light, heat or
power. But the term "electrical contractor" shall not include
! the installing or altering of 1) radio apparatus or equipment
i� for wireless reception of sounds and signals, or 2) apparatus,
!I conductors or other equipment installed for or by public
I� utilities, including common carriers, which are under the
jurisdiction of the Illinois Commerce Commission, for use in
�i their operation as public utilities. Nor shall the term
include the employees employed by an electrical contractor to
do or supervise his work.

(B) Registration Required: No person shall engage in the business
of electrical contracting within the City without first having
approved registration with the Director of Inspections and
Permits.
I(C) Registration Fee: The amount of the annual registration fee
for persons engaged in the business.of electrical contractor
shall be as approved by the City Council.
(D) Exemptions:
1. An electrical contractor who is registered in one city or
• village within the State of Illinois shall not be required by
any other municipality to be registered or to pay a
registration fee in such other municipality.

4-7-9: PENALTY: Any person who shall violate any provisions of
the National Electrical Code, 1987 Edition, or who shall
fail to comply with any of the requirements thereof, or who shall
change, move or alter any wiring apparatus, fixture, machinery, or
device in violation of any approved plan or'direction of the Director
of the Department of Building& Zoning or of any permit or certificate
issued under the provisions of the National Electrical Code, 1987
Edition, shall be guilty of an offense, punishable by a fine of not
less than fifty dollars ($50.00) or more than five hundred dollars
($500.00). A separate offense shall be deemed committed for each day
such violation shall occur or continue.
SECTION 3': That Section 4-7-10 of the City Code of the City of
Evanston, 1979, as amended, are further amended as
follows:
4-7-10: ADDITIONAL REGULATIONS:
(A) Treatment of Aluminum Wire:- All aluminum wire installed in any
installation shall be wire brushed and treated with a com-
pound according to manufacturers' recommendations.
(B) A dishwasher shall have a fused type "S" disconnect switch
readily accessible under the kitchen sink. A disposal without
a unit switch shall have a switch installed in the wall or
under the sink. Any changes from the provisions of this
subsection (b) shall be approved by the Director of Building
and Zoning of the City of Evanston."
Section 4: It is the intention of the City Council that the
provisions of this ordinance and the
National Electrical Code, 1987 Edition, are severable and the invalidity of
any section or part of any section of this ordinance and the code hereby
adopted shall not affect any other section or portion of said ordinance or
code.
Section 5: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 6: This ordinance shall be in full force and effect
from and after its passage, approval,
and publication in the manner provided by law.
