AN ORDINANCE
Granting a Special Use.at 1551 Sherman Avenue
WHEREAS, the Evanston Zoning Board of Appeals
conducted a public hearing on September 15, 1987 upon the
application of the First Illinois Bank of Evanston as Trustee
under Trust R-3927, Lawrence J. Starkman, sole beneficiary, and
David N. Woods, prospective tenant, for a special use to permit
establishment of a Type 2 Restaurant at 1551 Sherman Avenue,
property located in a B5 Business District; said hearing having
been conducted pursuant to notice and publication thereof in
the manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said special use be granted,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That, based upon the evidence and
testimony presented at the hearing, and
upon the deliberations and findings contained in the transcript
of Zoning Board of Appeals Case No. 87-21-SU(R), the
!'application of the First Illinois Bank of Evanston as Trustee
under Trust R-3927, Lawrence J. Starkman, sole beneficiary, and
11David N. Woods, prospective tenant, for a special use to permit
establishment of a Type 2 Restaurant at 1551 Sherman Avenue,
Evanston, Illinois, property located in a B5 Business and
legally described as follows:
Lot 7 (except the East 90 feet thereof) in Block 27 in the
Southeast 1/4 and the Southwest 1/4 of Section 18,
Township 41 North, Range 14 East of the Third Principal
Meridian, in Cook County, Illinois
is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the following
conditions:
1. Said Type 2 Restaurant shall be installed in
substantial compliance with the testimony presented
and the plans placed on file in connection with this
case and shall be limited to the store commonly known
as 1551 Sherman Avenue;
i 2. said Type 2 Restaurant shall be limited solely to the
serving of cold sandwiches, salads, prepackaged

snacks, beverages and desserts and no cooking shall
take place in said Type 2 Restaurant, except for
bread baking in electric convection ovens;
3.
no amusement devices, as defined in Section 3-8-1 of
the City Code shall be established or maintained

within said Type 2 Restaurant;
4.
the hours of operation of said type 2 Restaurant
shall be limited to 10:00 A.M. to 2:00 A.M., Monday
through Saturday and 10:00 A.M.'to midnight on
Sunday;
5.
said hours of operation stipulated in condition 4
shall be subject to review by the City Council one
year from the date of issuance of a Certificate of
Occupancy and Compliance for said Type 2 Restaurant.
6.
the litter collection plan submitted with the
application and appended as part of the ZBA report
number 87-21-SU(R) shall be instituted, except that
the 150 foot radius mentioned in paragraph 2 of said
document shall be increased to a 200 foot radius
exclusive of streets and alleys;
7.
the Ordinance granting the special use•for said Type
2 Restaurant and the litter collection plan,

submitted with the application in connection with
this case, shall both be prominently displayed within
the establishment.
SECTION 2: The Director of Building and Zoning
is hereby directed to issue such permits
pursuant to the terms of this ordinance.
SECTION 3: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 4: This ordinance shall be in full force
and effect from and after its passage,
approval, and publication in the manner provided.by law.
