AN ORDINANCE
j; Amending Section 5-1-3 of the City Code, 1979,
as Amended, to Include Provisions Pertaining
to Graffiti Removal
WHEREAS, the City Council of the City of Evanston has
noted a recent increase in the incidence of graffiti upon both
residential and commercial properties within the City; and

WHEREAS, the City Council finds that such graffiti is
unsightly and mars the aesthetic quality of neighborhoods.which
j citizens have worked hard to cultivate and maintain; and
WHEREAS, it is in the best interest of the community
to require owners of private property to maintain their
properties free of offensive markings; and
WHEREAS, the City Council believes that offenders who
cause such damage to the property of others are discouraged
when the victimized property owners promptly remove the
offending graffiti;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the Existing Structures Code, Title
5, Chapter 1 of the Evanston City Code, 1979, as amended, be
and hereby is further amended by the addition of a definition
of "graffiti" to Section 5-1-3(B) as follows:
5-1-3(B) ARTICLE 2
ES-200.3 Terms Defined in Other Codes: Where terms are
not defined in this article and are defined in the
Building, Plumbing or Mechanical Codes, or in the Evanston
Zoning Ordinance, they shall have the same meanings
ascribed to them as in those Codes.
ES-201.0 APPLIED MEANINGS OF WORDS AND TERMS:
Family: Delete.
Graffiti: Any and every name, identification description,
announcement, declaration, demonstration, display,
illustrations or insignia, other than advertising which is
otherwise provided for in. this Code, or other ordinances
of the City, which without authorization is marked,
written, drawn, painted, scratched, inscribed, or affixed
II directly to or upon any of the following objects or

structures: public or private curbstone, flagstone, or any
portion or part of any sidewalk or street or upon any
tree, lamppost, utility pole, postal mail receptacle,
sign, hydrant, gate, fence, door, wall, window, garage,
enclosure, vehicle, bridge, pier or upon any other public
or private structure or building.
SECTION 2: That the Existing Structures
• Code, Title 5, Chapter 1 of the.City Code
of the City of Evanston, 1979, as amended, be and hereby is

further amended by the addition of language pertaining to
;graffiti removal to Section 5-1-3(C) as follows:
5-1-3(C) ARTICLE 3
ES-301.6 Weeds: All areas shall be kept free from weeds
or plant growth in excess of 8 inches (203:2mm). Weeds
shall be defined as all grasses, annual plants and
vegetation other than trees or shrubs provided, however, !
this term shall not include cultivated flowers and
gardens. It shall be the duty of any person owning,
leasing, occupying, or controlling any plot'of ground in I
the jurisdiction to prevent the growth of weeds thereon.
ES-302.3.1 Foundation Walls: All foundation walls shall
be maintained so as to carry the safe design and operating
dead and live loads and shall be maintained plumb and free
from open cracks and breaks, so as not to be detrimental
to public safety and welfare. Cracks, breaks, or holes in
a foundation wall shall be repaired when they exceed 1/16
inch in width, 1z inch in diameter, or where there are
more than 4 holes less than lZ inch in diameter on a
plane.
ES-302.3.2 Exterior Walls: Every exterior wall shall be
free of holes, breaks, loose or rotting boards or timbers,
and any other conditions which might admit rain or
dampness to the interior portions of the walls or to the
occupied spaces of the building. All exterior surface
materials, including wood, composition, or metal siding,
shall be maintained weatherproof and shall be properly
surface coated when required to prevent deterioration.
Deteriorated surface protective materials in one location
exceeding 36 square inches, or 9 linear inches on a frame,
or lesser areas that occur in more than 5 locations on a

plane, shall be repaired.
ES-302.3.7 Stairs and -Porches: Every stair, porch, fire
escape, balcony, and all appurtenances attached thereto
shall be so constructed as to be safe to use and capable
of supporting the anticipated loads and shall be
maintained in sound condition and good repair. Every
stair or step shall have uniform risers and uniform treads
with nonskid surfaces. Risers shall not exceed 8 inches
in height and treads shall not be less than 9 inches in
width. Every stair, porch and fire escape shall be
maintained free of hazardous conditions such as snow, ice,
mud and other debris.
• Every flight of stairs which is more than four risers high
shall have a handrail on at least one side of the stair,
and every open portion of a stair, fire escape,.porch,
landing or balcony which is more than 30 inches (762mm)

above the grade below shall have guardrails. Handrails
shall be not less than 30 inches (762mm) nor more than 34
inches (864mm) high, measured vertically above the nosing
of the treads. Guardrails shall be not less than 30
inches (762mm) high above the floor of the porch, landing
or balcony. Every handrail and guardrail shall be firmly
fastened and capable of bearing normally imposed loads and
shall be maintained in good condition.
i. ES-302.4 Window and Door Frames: Every window, skylight,
door and frame shall be constructed and maintained in such
relation to the adjacent wall construction so as to
exclude rain as completely as possible, and to
substantially exclude wind from entering the dwelling or
structure.
ES-302.4.1 Weathertight: Every window, skylight, and
exterior door shall be fitted reasonably in its frame and
be weathertight. Weather stripping shall be used to
exclude wind or rain from entering the dwelling or
structure and shall be kept in sound condition and good
repair.
ES-302.4.2 Glazing: Every required window sash shall be
fully supplied with approved glazing materials which are
without open cracks and holes. Cracks in window glass
exceeding 2 inches in length shall be repaired by
replacement.of the window pane.
ES-302.4.4 Insect Screens: During the period from April
1 to November 1 for residential structures, and from April
1 to December 1 for all other structures, every door and
window or other outside opening used for ventilation
purposes serving any building containing habitable rooms,
food preparation areas, food service areas, or any areas
where products used in food for human consumption are
• processed, manufactured, packaged or stored, shall be
supplied with approved tight fitting screens of not less
than 16 mesh per inch and every swinging screen door shall
have a self -closing device in good working condition.
Screens having holes larger than Z inch in diameter shall
be replaced. Screens having more than 4 holes between 4"
and Z" shall be replaced.

Exception: Screen doors shall not be required for
out -swinging doors or other types of openings which make
screening.impractical, provided other approved means such
as air curtains or insect repellent fans are employed.
ES-302.5 Graffiti Removal: All exterior structure
surfaces must be kept clean and free of graffiti as
defined in Section 201.0. Surfaces which have been
exposed to graffiti must be cleaned, painted or in some
manner covered, so as to effect the complete removal of
the graffiti from that surface and to return the surface
to .its prior condition within 30 days of receipt of
violation notice to the owner. It shall be the
responsibility of the owner to comply with the provisions
of this subsection.
ES-303-3 Interior Surfaces: Floors, walls (including
windows and doors), ceilings, and other interior surfaces
shall be maintained in good, clean and sanitary condition.
• Peeling paint, cracked or loose plaster, decayed wood, and
other defective surface conditions shall be eliminated.
Cracks other than hairline, except where there is water

infiltration or seepage or where the surrounding material
is jeopardized, are to be repaired. Deteriorating, loose
or missing paint, wallpaper, or plaster is to be repaired
if there is one location of more than 4 inches by 4
inches, or where there are more than 2 smaller areas on
one plane. Holes more than one inch in diameter are to be
repaired .and painted; smaller holes are to be repaired if
i' there are more than 4 on any one plane, or where they
• endanger personal safety. All loose materials are to be
removed. Surfaces are to be clean, sanitary, and properly
sealed by paint or other washable compounds.
ES-303.3.2 Bathroom and Kitchen Floors: Every toilet,
bathroom and kitchen floor surface and juncture with the
wall shall be constructed and maintained so as to be
substantially impervious to water and so as to permit such
floor to be easily kept in a clean and sanitary condition.
'i This provision shall not be interpreted as preventing the
use of carpeting.
ES-303.7 Exit Doors: Double cylinder locks shall be
prohibited from use on exit doors to dwelling units when
such exit doors are located in dwelling units with only a
single means of egress or ingress.
ES.-303.8.1 Exit Facilities: All interior'stairs and
i railings and other exit facilities of every structure
shall be maintained in sound condition and good repair by
replacing treads and risers that evidence excessive wear
or are broken, warped or loose. Every inside stair or
i step shall have uniform risers and uniform treads with
nonskid surfaces. Risers shall not exceed eight inches
(8") in height and treads shall not be less than nine
inches (9") in width.
SECTION 3: All ordinances or parts of ordinances

in conflict herewith are hereby repealed.
SECTION 4: This ordinance shall be in full force
and effect from and after its passage,
j approval, and publication in the manner provided by law.
