HomeMy WebLinkAboutORDINANCES-1987-071-O-877/21/87 • 71-0-87 AN ORDINANCE Granting Variations from Use and Nonconforming Building Structure and Use Regulations at 1001 Sherman Avenue WHEREAS, the Evanston Zoning Board of Appeals conducted a public hearing on July 7, 1987 upon the application is of Rose Fisher as beneficiary under the American National Bank of Chicago, Trust 52882, for variations from the use and !` nonconforming building structure and use regulations of the Zoning Ordinance to permit retention of the nonconforming building and nonconforming use thereof as a part of a lumber i; yard, including open, accessory off-street parking associated therewith, beyond the established elimination date of September i; `I 23, 1988, at 1001 Sherman Avenue, Evanston, Illinois, property located in an R3 Two -Family Residence District; said hearing i� having been conducted pursuant to notice and publication I j! thereof in the manner prescribed by law; and i! WHEREAS, the Zoning Board of Appeals has recommended • that the application for said variations be granted, is NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF i THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the application of Rose Fisher as beneficiary under the American National Bank of Chicago, Trust 52882, for variations from the use and nonconforming building structure and use regulations of ! the Zoning Ordinance to permit retention of the nonconforming ' building and nonconforming use thereof as a part of a lumber i yard, including open, accessory off-street parking associated therewith, beyond the established elimination date of September 23, 1988, on property located at 1001 Sherman Avenue, Evanston, Illinois and legally described as follows: i Lot 5 in Nicholas Mersch's Addition to South Evanston, in • j' the SZ of the N.W. a of Section 19, Township 41 North, !� Range 14, East of the Third Principal Meridian, in Cook if County, Illinois is granted, subject to compliance with all other provisions of H • r� 71-0-87 i the Zoning Ordinance, other applicable laws and the following conditions: 1. In the event that either or both of the two buildings on the subject property are damaged by fire or other casualty beyond 50% of the cost of restoring said building or buildings new, said buildings may be rebuilt, provided that the required front yard and side yard setbacks required in the district in which they are located, are provided; 2. The use of the front building on the subject premises shall be limited to sales, display and office use and the rear building shall be limited to the storage of millwork, related accessories and display; 3. The parking area on the premises shall be brought into compliance with respect to the screening and wheelstop requirements of the Ordinance, and to the extent possible, said parking area shall also be brought into compliance with the stall width, stall depth, aisle width and module width requirements of the zoning Ordinance; SECTION 2: The Director of Building and Zoning is hereby directed to issue such permits pursuant to the terms of this ordinance. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
