July 8, 1987 I c fi 68-0-87 fi AN ORDINANCE • I • Granting a Variation from the Use and Nonconforming Building Structure and Use Regulations at 500 Dodge Avenue WHEREAS, the Evanston Zoning Board of Appeals con- ducted a public hearing on January 13, 1987 and again on f February 24, 1987 upon the application of John R. Sladkey, Lois U. Sladkey, Robert J. Sladkey, Evelyn W. Sladkey and Carol A. Karstensen, owners; the Shell Oil Company, lessee and James Owens, sublessee; for variations from the use and nonconforming building structure and use regulations of the Zoning Ordinance to permit retention of the existing building and continued use as an automobile service station which were to be terminated on December 27, 1984, on the property located at 500 Dodge Avenue, Evanston, Illinois in an R5 General Resi- dence District; said hearings having been conducted pursuant to, notice and publication thereof in the manner prescribed by law; and WHEREAS, the Planning and Development Committee of the City Council at a public meeting on June 22, 1987, based on! an analysis and review of the record of the Zoning Board of Appeals hearings, including the application, documents and 1 transcript, has recommended that the application for said variations be granted; and WHEREAS, the City Council finds that there is a par- ticular hardship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance in this case; and that the proposed variations would be in harmony with the general purpose and intent of the ordinance in that the present use as a service station has been continuous since 1955 and provides a readily accessible and needed service to area residents. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF; THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: .i SECTION 1: That the application of John R. Sladkey, Lois U. Sladkey, Robert J. Sladkey, Evelyn W. Sladkey and Carol A. Karstensen, owners; the Shell Oil Company, lessee and James Owens, sublessee; for variations from the use and nonconforming building structure and use regulations of the Zoning Ordinance to permit retention of the ' existing building and continued use as an automobile service C] • .7 station which were to be terminated on December 27, 1984, on the property located at 500 Dodge Avenue, Evanston, Illinois, and legally described as follows: Lots 38, 39, 40, 41 and 42 in Block 4 in Ellsworth T. Martin's Subdivision of the south half of the southeast quarter of the southwest quarter of Section 24, Township 41 north, Range 13 east of the third principal meridian in Cook County, Illinois, excepting from said premises that part thereof lying east of a line 40 feet west of and parallel to the east line of the southwest quarter of Section 24 aforesaid taken for the widening of Dodge Avenue, is granted, subject to compliance with all other provisions of the Zoning Ordinance, other applicable laws and the following conditions: 1. The variations granted herein shall be limited to operation of the subject automobile service station by James Owens, Sr., the current sublessee, or James Owens, his son; and 2. The hours of operation of said automobile service station shall be limited to 6 A.M. to 10 P.M. Monday through Saturday and 9 A.M. to 6 P.M. Sunday. SECTION 2: SECTION 3: Introduced: Adopted: The Director of Building and Zoning is hereby directed to issue such permits as necessary pursuant to the terms of this ordinance. !
