AN ORDINANCE
FOR THE CONSTRUCTION OF A LOCAL IMPROVEMENT
KNOWN AS
EVANSTON SPECIAL ASSESSMENT NO. 1368
BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF EVANSTON, ILLINOIS:
Section 1: That a local improvement shall be made within the City of
Evanston, County of Cook and State of Illinois, the nature, character,
locality and description of which is as follows, to -wit:
That Colfax Place, 285 feet East of the East line of Crawford
Avenue in the City of Evanston be improved by grading,
constructing the necessary drainage system, with concrete curb
and gutter, and paving to a width of thirty (30') feet with
Portland Cement concrete eight inches (8") thick, or with
Bituminous Aggregate Base Course seven inches (7) thick and
Bituminous Surface Course two inches (2") thick.
Section 2: That the ReconTnendation of this Ordinance by the Board of
Local Improvements of the City of Evanston, Illinois, and the Estimate of the
cost of said improvement made by the Engineer of said Board, both hereto
attached, be and the same are hereby approved and by reference thereto made a
part hereof;
Section 3: That said improvement shall be made and the cost thereof,
including the sum of Ninety-eight Thousand Two Hundred Sixty-two and 96/100ths
Dollars ($98,262.96), being the cost of making and collecting the Assessment
and all other expenses as provided by law, shall be paid for by Special
Assessment in accordance with the Illinois Municipal Code, Chapter 24, Section
9, Division 2, approved May 29, 1961 and all amendments thereto, and Chapter
1.5, Title 7 of the City Code of the City of Evanston, 1979, as amended.
Section 4: That Fifty-seven Thousand Eight Hundred Ninety-four and
72/100ths Dollars ($57,894.72) of the cost of said improvement shall be
allocated as public benefit, to be paid by the City, and the remainder of
Forty Thousand Three Hundred Sixty-eight and 24/100ths Dollars ($40,368.24) as
private benefit.
Section 5: That the aggregate amount to be assessed and each individual
assessment shall be divided into ten installments in the manner provided by
law, and each of said installments shall bear interest at the rate of seven
per centum (70) per annum from sixty.(60) days after the date of the first
voucher issued on account of work done upon said proposed improvement;
Section 6: That for the purpose of anticipating the collection of the
installments of said assessment levied against the real estate benefited
• thereby, bonds shall be issued payable out of said installments, bearing
interest at the rate of seven per centum (70) per annum, payable annually and
signed on behalf of the City of Evanston, Illinois, by its Mayor and attested
by its City Clerk and its corporate seal affixed thereto; and each interest
coupon attached to said bonds shall likewise be executed by and shall bear the
official or facsimile signature of the same officers who signed said bonds and
who if facsimile signatures are used, do adopt by their execution of said
bonds as and for their proper signatures their respective facsimile signatures
appearing on said coupons; and that said bonds shall be issued in accordance
with and shall in•all respects conform to the provisions of an Act of the
General Assembly of the State of Illinois, known as the "Illinois Municipal
Code," effective July 1, 1961 and the Amendments thereto;
Section 7: That Stephen Pudloski, President of the Board of Local
Improvements of the City of Evanston, Illinois, be and he is hereby directed
to file a Petition in the County Court of Cook County, Illinois, praying that
steps may be taken to levy a Special Assessment to pay the cost of said
improvement in accordance with the provisions of this Ordinance and in the
manner prescribed by law;
Section 8: That all Ordinances or parts of Ordinances conflicting with
this Ordinance be and the same are hereby repealed; and
Section 9: That this Ordinance shall be in force and effect from and
after its passage and approval according to law.

The Board held a Public Hearing for the proposed paving of Colfax Place,
east of Crawford Avenue, Special Assessment 1368, at 7:30 P.M. in Room
2401 in the Civic Center located at 2100 Ridge Avenue, Evanston, Illinois.
The Chair called the meeting to order at 7:38_ P.M.
The Chair introduced the members of the Board, indicating their staff posi-
tion with the City and the requirement that they be on the Board.
The Chair then explained the Special Assessment process and reported to those
• present that the City Council had mandated that all unpaved streets be paved
in 1979 and, at that time, there were approximately'14.5 miles of unpaved
streets. He further explained the cost sharing process in assessing the
property owners for the paving of the streets. He also informed them of
the five-year plan to pave the remaining four miles of unpaved streets that
currently exist.
The Chair also explained the method of collection for the assessment using a
$10,000 assessment as an example explaining that the principle would be divided
into ten equal parts for annual installments of $1,000 with 7% simple interest
charged on the unpaid balance. He explained the ability of the property owners
to pay a portion, or all, of their assessment within a sixty-day period after
the court orders collection on the assessment, without interest charges.
The Chair then turned the meeting over to the Engineer for the Board who
covered the two estimates... one for paving the street with asphalt and the
estimate for the alternate for paving the street with concrete. With.the use
of the visual aids present he explained the scope of the work and the function
of the design. A discussion ensued in which the Engineer for the Board answered
questions concerning adequate drainage, the difference between the two materials,
concrete and asphalt, as a paving surface, the size of the existing sewer and
the width of the parkways that were proposed.

''he three residents present requested that the street be constructed to a
width of thirty feet from face of club to face of curb, in hell of the
proposed twenty_ -seven feet (27'), thereby allowing parking on both sides
of the street. The residents present were concerned about the speed of
traffic using Colfax Place and the president for the Board indicated that
he would contact the Traffic Engineer to determine if the alley at the
east end of the street should be made a one-way alley north.
A discussion between the President and Mr. Olkowski with the residents
present ensued in which the snow removal operations were discussed. The
President assured the people present that they would have full service,
i.e., street sweeping, snow removal and other city maintenance functions.
There being no further questions concerning the scope of the project, the
Engineer for the Board, with the use of a visual aid, explained the manner
of assessing fhe land parcels for the project. He indicated that the cost
for assessable foot, as based on the estimate, is $99.00. A discussion took
place in which the Engineer for the Board identified the properties that
were being assessed and indicated the properties of those present. The
citizens requested that trees be considered for installation on the park-
ways where they would be appropriate, to which the President for the Board
answered he would have the Arborist examine Colfax Place after the street
was paved for possible installation of trees.
• There being no further questions, the President of the Board asked for a
motion concerning the paving of Colfax Place. Mr.. Tonkinson made a motion
to amend the design to provide for a thirty-foot (30') wide street and to
recommend to the City Council that the Special Assessment process proceed
and to adhere to the first resolution of the Board as amended. Mr. Olkowski
seconded the motion which passed unanimously.
The members of the Board then signed the recommendation and the amended
adhering resolution. There being no further business, the President adjourned
the Public Hearing at 8:45 P.M.

To the Board of Local Improvements of the City of Evanston:
Pursuant to a Resolution of the Board of Local Improvements of the City of
Evanston, heretofore adopted that Colfax Place, 285 feet East of-t-e East
line of Crawford Avenue in the City of Evanston to be improved by grading,
constructing the necessary drainage system, with concrete curb and gutter,
and paving to a width of thirty feet (30') with Portland Cement Concrete
eight inches (8") thick.
Said improvement to be constructed in detail as specified in aforesaid
Resolution.
I herewith submit an estimate of cost of such improvement as described in
said Resolution, including labor, materials and all other lawful expenses
attending the proceedings for making said improvement and the cost of making
and collecting the assessment therefore as provided by law, viz:

RECOMMENDATION OF THE BOARD OF LOCAL IMPROVEMENTS
TO THE CITY COUNCIL OF THE CITY OF EVANSTON, ILLINOIS
The Board.of Local Improvements of the City of Evanston, Illinois,
herewith submits the draft of an Ordinance for the making of a local im-
provement within the City of Evanston, County of Cook and State of Illinois,
the nature, character, locality and description of which is as follows, to
wit:
That Colfax Place, 285 feet East of the East line of Crawford
Avenue in the City of Evanston be improved by grading, construct-
ing the necessary drainage system, with concrete curb and gutter,
and paving to a width of thirty feet (30') with Portlant Cement
Concrete eight inches (8") thick, or with Bituminous Aggregate
Base Course seven inches (7") thick and Bituminous Surface Course
two inches (2") thick,
and as part of said Ordinance and in conjunction therewith, said Board also
herewith submits the Plans and Specifications of, and the Estimates of, the
cost of said improvement, including the cost of engineering services, as
finally determined by said Board; and said Board hereby recommends the
passage of said Ordinance and the making of the improvement described
therein.
