HomeMy WebLinkAboutORDINANCES-1988-089-O-8889-0-88 AN ORDINANCE Amending Title 5 of the Evanston City Code by Adding a New Chapter 7 Pertaining to Burglary Prevention • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: • SECTION 1: That Title 5 of the City Code of the City of Evanston, 1979, as amended, be and hereby is further amended by the addition of the following new Chapter 7 entitled "Burglary Prevention", establishing standards for maintenance of residential structures for resistance to unlawful entry; CHAPTER 7 BURGLARY PREVENTION SECTION: 5-7-1: Purpose 5-7-2: Scope; Enforcement 5-7-3: Maintenance; Responsibility for Security 5-7-4: Alternate Materials and Methods of Construction; Tests 5-7-4-1: Alternate Materials and Methods of Construction 5-7-4-2: Tests 5-7-5: Definitions 5-7-6: Minimum Standards 5-7-6-1: All New Residential Constructions 5-7-6-2: Multi -Family Dwellings: Existing and Single Family Renter Occupied 5-7-7: Appeals 5-7-8: Violations and Penalties 5-7-1: PURPOSE r The purpose of this Ordinance is to provide minimum standards to safeguard property and public welfare by regulating and controlling the design, construction, quality of materials, use and occupancy, location, and maintenance of all residential buildings and structures within the City of Evanston and certain equipment specifically regulated herein for resistance to unlawful entry. 5-7-2: SCOPE: ENFORCEMENT The provisions of this Ordinance shall apply to: (A) All new residential construction or change within a building to a residential use; (B) All multi -family residential buildings one year from passage of this Ordinance; (C) Single-family dwelling units which are renter -occupied. Exclusions: (A) Residence at a public or private medical, geriatric, educational, or religious institution; • (B) Occupancy under a contract of sale of an existing dwelling unit if the occupant is the purchaser; (C) Occupancy in a structure operated for the benefit of a social or fraternal organization; (D) Transient occupancy in a hotel or motel. 5-7-3: MAINTENANCE: RESPONSIBILITY FOR SECURITY: All devices or safeguards which are required by this Ordinance in a residential building shall be maintained in good working order. The owner or his designated agent shall be responsible for the maintenance of such devices or safeguards. The owner or his designated agent shall be responsible for compliance with the specifications set forth in this Ordinance. 5-7-4: ALTERNATE MATERIALS AND METHODS OF CONSTRUCTION: TESTS: 5-7-4-1: ALTERNATE MATERIALS AND METHODS OF • CONSTRUCTION: The provisions of this Ordinance are not intended to prevent the use of any material or method of construction not specifically prescribed by this Ordinance, provided such alternate has been approved by the enforcing authority. The enforcing authority may approve any such alternate, provided he/she finds that the proposed design will satisfactorily perform its intended function and that the material, method or work will be at least the equivalent of that prescribed in this Ordinance in quality, strength, effectiveness, durability, and safety. 5-7-4-2: TESTS: Whenever there is insufficient evidence of compliance with the provisions of this Ordinance, or evidence that any material, or any construction does not • conform to the requirements of this Ordinance, or in order to substantiate claims for alternate materials or methods of construction, the enforcing authority may require tests as proof of compliance. These tests are to be made at the expense of the owner and may require ASTM F 476-84 methods of testing. -2- 5-7-5: DEFINITIONS: (A) ACCESSIBLE: Refers to any opening in the exterior of a building larger than 8 inches by 12 inches (e.g., door, window, transom, vent duct, skylight, etc.) that is within either: • 1. 18 feet from the ground or the roof of an adjoining structure; 2. 4 feet from directly or diagonally opposite windows, fire escapes, ledges, or roofs; 3. 4 feet of another opening larger than 8 inches by 12 inches, fire escapes or ledges in or projecting from the same wall, or an adjacent wall and leading to another building or structure. (B) BURGLAR -RESISTANT GLAZING MATERIAL: Glass and glass -like materials shall comply with or exceed the Underwriters Laboratories Standard #UL 972 for Burglary Resistant Glazing Material as follows: The glazing material shall be capable of withstanding five 50 foot-pound impacts, as produced by dropping a 3-1/4 inch diameter hardened smooth steel ball, weighing 5 pounds, through a vertical distance of 10 feet. (C) COMBINATION DEAD LATCH AND DEAD BOLT: A device combining a dead latch operable by knobs or non -removable key from inside and outside by a key, both of which can be retracted from the inside by turning the knob or non -removable • key and from the outside by a key. (D) CYLINDER GUARD: A hardened steel ring or plate surrounding the otherwise exposed portion of a cylinder lock to prevent cutting, prying, pulling or wrenching with common tools. (E) DEAD BOLT: A bolt which has no automatic spring action and which is operated by a key, thumb -turn, or lever, and is positively held fast in the protected position. (F) DEAD LATCH: A latch which positively held in latched position with a strike by an added integral bolt -type mechanism and is again released by a key from the outside and a knob or similar actuator from the outside. (G) DOOR SCOPE: A system of lenses encased for convenient installation in entrance doors permitting an inside viewer to observe a 1800 area of the outside with the door closed. (H) DOUBLE -CYLINDER DEAD BOLT: A dead bolt lock actuated by a key from the • inside and outside. (I) INSERT: A hardened steel roller inside unhardened bolts to prevent bolt cutting with common tools. -3- (J) LATCH: A spring -loaded device which automatically holds a swinging door shut upon closing by engaging a strike and which is released by turning a knob, lever, or similar actuator from inside or outside. (K) LOCK STRENGTH: Dead bolt locks constructed of a hardened steel material, the entire unit being capable of maintaining its intended function in the locked position for a minimum of five minutes of constant attack with a common tool. (L) MORTISE -TYPE LOCK: A lock placed into an opening cut in the edge of a door. (M) MULTI -FAMILY DWELLING: A building or portion thereof, operating under a rental agreement, including renter -occupied cooperatives and condominium units. (N) MULTIPLE POINT LOCKS: A system of lever -operated bolts that engages a door opening, at the head and sill as a minimum, operated by a single knob or handle from the inside, and, optionally, a cylinder -locked handle from the outside. (0) RABBETED JAMB: The wooden sides and head of a door cut in such a way so that a notch is created against which the door may be closed. (P) RIM -TYPE CYLINDER LOCK: A lock made for mounting on the face of a door. (Q) SASH FASTENERS: Locking devices which prevent a window from being . moved. (R) SINGLE CYLINDER DEAD BOLT: A dead bolt lock activated from the outside by a key and from the inside by a knob, thumb -turn, lever, or similar actuator. (S) SINGLE-FAMILY DWELLING: A building containing one owner -occupied dwelling unit; an owner -occupied condominium unit or cooperative. (T) SINGLE FAMILY RENTAL: A unit operating under a rental agreement. (U) STRIKE: A stationary metal plate designed to momentarily depress a moving latch for final secure engagement requiring a separate operation for disengagement. 5-7-6: MINIMUM STANDARDS: 5-7-6-1: ALL NEW RESIDENTIAL CONSTRUCTION: (A) Exterior doors assemblies and doors assemblies leading from garage areas into private dwellings shall meet ASTM F 476-84 Grade 40. • (B) Glazing panels in exterior doors or within 40 inches of the inside activating device must be of rated burglar -resistant glazing material as herein defined except where waived by the enforcing authority. -4- (C) Exterior doors swinging out shall have non -removable hinge pins and/or t steel dowels projecting a minimum of 1/2 inch from one plate into the opposite plate of the hinge. (D) Exterior in -swinging doors shall be rabbeted jambs with a 3/4 inch rabbeted stop. Exterior out -swinging doors shall have non -removable pins in • the hinges (butts). (E) Jambs for all doors shall be so constructed or protected so as to prevent violation of the functions of the strike. (F) Cylinder guards shall be installed on all mortise or rim -type cylinder locks whenever the cylinder lock projects beyond the face of the door or is otherwise accessible to gripping tools except where an alternate lock is provided. (G) An interviewer or door scope shall be provided in each entrance door which does not contain a vision panel. (H) Accessible sliding glass doors shall meet or exceed Class II as defined in "Physical Security for Sliding Doors NILECJ-FTO-0318.000" October, 1976 (National Bureau of Standards, Washington, D.C.). Aluminum sliding glass doors and windows shall meet or exceed the Architectural Aluminum Manufacturer's Association standards as set forth in their bulletin, "AAMA 0 1302.3-1971". (I) All accessible single sliding doors shall have the movable section of the doors sliding on the inside of the fixed portion of the door. (J) Accessible windows shall be so constructed that when the window is locked it cannot be lifted from the frame. (K) Accessible window -locking devices shall be capable of withstanding a force of 300 pounds applied in any direction. (L) Outside hinges on all accessible windows shall be provided with non -removable pins. (M) All wooden double -hung windows which are at ground level or otherwise accessible from the exterior via porches, fire escapes, trees, or other existing means shall be equipped with approved window ventilating sash fasteners to allow each window to be locked at no more than 4 inches open. Such fasteners shall be movable to permit the window to be fully opened from • the inside of the dwelling unit. -5- (N) Locks on entrance doors to individual units shall have dead bolt locks with one -inch minimum throw and hardened steel inserts, or locks of equivalent strength, except it is permissible to have double -cylinder dead bolt locks where the key cannot be removed when door is locked from the inside, in units with a single means of egress and ingress. 5-7-6-2: MULTI -FAMILY DWELLINGS: EXISTING AND SINGLE-FAMILY RENTER -OCCUPIED (A) Exterior doors, doors leading from garage areas into multiple dwelling buildings, and doors leading into stairwells shall be equipped with self -closing devices. All doors leading to apartment doors shall also be equipped with self-locking devices. (B) Locks on entrance doors to individual units shall have dead bolt locks with one inch minimum throw and hardened steel inserts, or locks of equivalent strength, except it is permissible to have double -cylinder dead bolt locks where the key cannot be removed when the door is locked from the inside, in units with single means of egress and ingress. (C) Accessible vision panels in individual entrance doors to individual units or within 40 inches of the inside activating device shall be of rated burglary -resistant glazing material. • (D) An interviewer or doorscope shall be provided in each individual unit entrance door which does not contain a vision panel. (E) Cylinder guards shall be installed on all mortise or rim -type cylinder locks whenever the cylinder projects beyond the face of the door or is otherwise accessible to gripping tools except where an alternate lock is provided. (F) Accessible sliding glass doors shall meet or exceed the Architectural Aluminum Manufacturers' Association standards as set forth in their bulletin, "AAMA 1303.3-1971". Also, "Physical Security For Sliding Glass Doors NILECCJ-FTO-0318.000" Oct. 1976 (National Bureau of Standards, Washington, D.C.). (G) All accessible single sliding patio doors shall have the movable section of the door sliding on the inside of the fixed portion of the door. (H) Accessible sliding glass doors shall be equipped with locking devices • and shall be so installed that the doors cannot be moved in any direction or lifted from the track when the doors are in the locked position. (I) Accessible windows shall be so constructed that when the window is locked it cannot be lifted from the frame. 1 -6- (J) Accessible window -locking devices shall be capable of withstanding concentrated force of 300 pounds applied in any direction. (K) Accessible aluminum sliding glass windows shall meet or exceed the Architectural Aluminum Manufacturers' Association Standards as set forth in their bulletin "AAMA 1302.3-1971". (L) All exterior common entrances of multiple family buildings shall be • illuminated with a minimum of 5 ft. candles measured at 3 ft. above threshold level, 3 ft. in front of the door. (M) All wooden double -hung windows which are at ground level or otherwise accessible from the exterior via porches, fire escapes, trees, or other existing means shall be equipped with approved window -ventilating sash fasteners to allow each window to be locked at no more than 4 inches open. Such fasteners shall be movable to permit the window to be fully opened from the inside of the dwelling unit. 5-7-7: APPEALS In order to prevent or lessen unnecessary hardship or practical difficulties in exceptional cases where it is difficult or impossible to comply with the strict letter of this Ordinance, and in order to determine the suitability of alternate materials and types of construction, and to provide for reasonable • interpretations of the provisions of this Ordinance, an owner of any residential building, or his designated agent, may appeal to the Building Code Appeals Board. 5-7-8: VIOLATIONS AND PENALTIES: It shall be unlawful for any person, firm, or corporation, to erect, construct, enlarge, alter, repair, move, improve, remove, convert, equip, use, occupy, or maintain a multi -family residential building or structure in the City of Evanston, or cause the same to be done, unless done in conformance with the provisions of this Ordinance. Any person, firm, or corporation in violation of any of the provisions of this Ordinance, for each such violation such person, firm or corporation shall be punished by a fine of not less than $25.00 nor more than $500.00. Each day • that a violation is permitted to exist shall constitute a separate offense. SECTION 2: All resolutions, motions, or Ordinances in conflict herewith are hereby repealed to the extent of such conflict. -7- SECTION 3: Should any section, clause or provision of this Ordinance • • �J be declared by the Court to be invalid, the same shall not affect the validity of this Ordinance as a whole or any part thereof other than the part so declared to be invalid.
