HomeMy WebLinkAboutORDINANCES-1988-075-O-88f 10-11-88 0 0 • NWIMMUz AN ORDINANCE Granting a Special Use at 601 Ridge Avenue WHEREAS, the Evanston Zoning Board of Appeals conducted a public hearing on June 21, 1988 and July 19, 1988 upon the application of Israel Frankel and Deborah Frankel for a special use to permit retention of an eighteen foot (181) high earth satellite station antenna with an eight foot (8') diameter mesh dish instead of the existing eight foot (8') diameter solid dish on the property located at 601 Ridge Avenue, property located in an R1 Single -Family Residence District; said public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Planning and Development Committee of the City Council at public meetings conducted on September 26, 1988 and October 10, 1988, based upon an analysis and reivew of the records of the Zoning Board of Appeals hearings, the applicants' statements at said meeting with respect to the proposed replacement of the solid dish with a mesh dish, and the acceptance by said applicants' of the conditions embodied in this Ordinance, has recommended the application for said special use be granted; and WHEREAS, based upon the application and the testimony and evidence presented, the City Council of the City of Evanston finds that, as to the special use requested for the subject property: A. The existing earth satellite station with the proposed revision thereto is so designed and located that the public health, safety and welfare will be protected since it is in conformity with all the regulations pertaining to location and design, except for the height thereof the impact of which will be ameliorated by the replacement of the existing eight foot (8') diameter dish with a mesh dish of no more than eight feet (8') in diameter; B. The retention of the subject earth satellite station, as modified by the instant proposal, will not cause appreciable injury to the value of other property in the neighborhood in which it is located since the installation of a mesh dish in place of the solid, -1- 75-0-88 dish now in existence will soften the visual impact that said earth satellite station has on the surrounding neighborhood; C. Said earth satellite station, as modified under the instant proposal, will not subvert or defeat the primary purpose of the Zoning Ordinance or of the.:, Zoning District or area for which it is proposed,- when its effect is considered in conjunction with the • ;`,= cumulative effect of the number of various special. uses of all types already located in the adjacent area and in City as a whole; D. The earth satellite station conforms to all the applicable regulations of the district in which it is located, except for the fact that it exceeds the maximum height of twelve feet (12') allowable by six feet (6') for a total height.of eighteen feet (18'), which is the subject of this special use request. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the.evidence and testimony presented at the hearings, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 88-13-SU(R), and upon the testimony presented at the Planning and Development Committee meetings and upon the deliberations and findings of fact of the Planning and Development Committee, the },` • application of Israel Frankel and Deborah Frankel for a special use to permit retention of an eighteen foot (18') high earth,' satellite station antenna with an eight foot (8') diameter mesh dish instead of the existing eight foot (8') diameter solid' dish on the property located at 601 Ridge Avenue, property ; a located in an R1 Single -Family Residence District and legally described as follows: LOT 6 (EXCEPT THE EAST 50.0 FT. THEREOF) IN BLOCK 3, IN ' OSBORN AND SKILLMAN'S SUBDIVISON OF THE SOUTH 12 i ACRES OF LOT 9 IN ASSESSOR'S DIVISION OF THE SOUTHWEST QUARTER, OF SECTION 19, TOWNSHIP 41 NORTH,�RANGE 14, EAST OF THEE:' THIRD PRINCIPAL MERIDIAN, IN COOK,COUNTY, ILLINOIS., is granted, subject to compliance with all other provisions of the Zoning Ordinance and other applicable laws and the " following conditions: . h ' 1. The owner shall remove the existing solid dish and", replace it with a mesh dish which is neutral in color and not in excess of eight feet (8') in diameter;.' -2- r, 75-0-88 2. The maximum height of said earth satellite receiving station shall not exceed eighteen feet (181) in ' height as measured from grade to the top of the mesh dish; and �r 3. The applicants' shall make application for all requisite permits that should have been secured.prior d; to installation of the earth satellite station on the 'y premises, and shall pay all fees and provide all documents necessary to result in issuance of permits for said earth satellite station. ('ADD BOILER PLATE) SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
