HomeMy WebLinkAboutORDINANCES-1988-064-O-880 AN ORDINANCE Authorizing the Sale of Certain Municipally Owned Real Property WHEREAS, the City of Evanston owns the real property, r • the easterly half of a vacated alley behind 803 & 805'Sherman Avenue and adjacent to the west boundary of Eiden Park in the City of Evanston legally described as follows and hereinafter referred to as the "Property": The Easterly One -Half of the North -South 8 Feet Public Alley, East of and adjoining to Lot 4 and Lot 5 of W.G. Hoag's Subdivision, of Lot 8 and Lot 9 in Block 6 of Adams and Brown's Addition to the City of Evanston in the Southwest a of Section 19, Township 41 North, Range 14 East of the Third Principal Meridian in Cook County, Illinois. WHEREAS, the City Council of the City of Evanston has t determined that the use of the Property is no longer necessary, appropriate, required, or in the best interest of the City of Evanston; and WHEREAS, the City Council of the City of Evanston has determined that the best interest of the City of Evanston would • be served by the sale of said Property to qualified parties for their private use; and WHEREAS, pursuant to Ordinance 52-0-88 of the City of Evanston adopted September 13, 1988, the City Council by a vote of 2/3 of the elected Alderman then holding office did direct that the process to sell said Property shall be by negotiation and that the City Manager shall be authorized to negotiate on behalf of the City; and WHEREAS, pursuant to said ordinance said negotiations have occurred; and WHEREAS, the City Manager recommends that a sale between the City of Evanston, as seller, and Paul and Jeanne Breslin, and Deborah Mack and Yehia Yehia, as buyers, be accepted by the City. Said contracts are marked as Exhibits A • and B, attached hereto and incorporated herein by reference; and WHEREAS, the City Council finds and determines that -1- the best interest of the City of Evanston and its residents will be served by the acceptance of the contracts on the terms as set forth in attached Exhibits A and B; and WHEREAS, the notice of intent to sell has been published in a newspaper of general circulation in th6 City bf • Evanston as required by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: set forth. SECTION l: The City Council of the City of Evanston finds as fact the recitals hereinabove SECTION 2: The negotiated sale to Paul and Jeanne Breslin, and Deborah Mack and Yehia Yehia, as buyers, attached as Exhibits A and B hereto, is hereby accepted by the City Council of the City of Evanston for the following described real property: The Easterly One -Half of the North -South 8 Feet Public Alley, East of and adjoining to Lot 4 and Lot 5 of W.G. Hoag's Subdivision, of Lot 8 and Lot 9 in Block 6 of Adams and Brown's Addition to the City of Evanston in the Southwest 4 of Section 19, Township 41 North, Range 14 • East of the Third Principal Meridian in Cook County, Illinois, commonly known as a portion of the vacated alley behind 803 and 805 Sherman Avenue. SECTION 3: The City Manager is hereby authorized and directed to sign, and the City Clerk is hereby authorized and directed to attest, contracts for the sale of the aforesaid real property, which contracts shall be in accordance with attached Exhibits A and B. The City Manager is further authorized to negotiate any changed or additional terms and conditions with respect to the sale of the aforesaid real property as may be deemed fit and proper. SECTION 4: The City Manager and the City Clerk, respectively, are hereby authorized and • directed to execute, attest and deliver such other documents, agreements and certificates as may be necessary to the sale -2- 64-0-88 herein authorized, including other documents referred to in said contracts. SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Paul Breslin and Jeanne Breslin (Purchasers) agree to purchase at a price of Seven Hundred Eighty -Nine Dollars ($789.00) on the terms set forth herein, the following described real estate in Cook County, Illinois. (hereinafter referred to as the property): The Northerly 35 feet of the Easterly One -Half of the North -South 8 Feet Public Alley, East of and adjoining to Lot 4 and Lot 5 of W.G. Hoag's Subdivision, of Lot 8 and Lot 9 in Block 6 of Adams and Brown's Addition • to the City of Evanston in the Southwest a of Section 19, Township 41 North, Range 14 East of the Third Principal Meridian in Cook County, Illinois. corrmonly known as a portion of the vacated alley behind 805 Sherman Avenue. 2. The City of Evanston, a municipal corporation (Seller), agrees to sell the property described above at the price and terms set forth herein, and to convey or cause to be conveyed to Purchasers by a recordable quitclaim deed, subject only to : (a) covenants, conditions and restrictions of record; (b) private, public and utility easements and roads and highways, if any; (c) real estate taxes, if any. 3. Purchasers agree to place the property on the tax roles and to perform or cause to be performed any necessary replatting of the property. 4. Seller warrants that Seller, its beneficiaries or agents of Seller or of its beneficiaries has received no notices from any City, village or other governmental authority of zoning, building, fire or health code violations in respect to the real estate that have not been heretofore corrected. 5. Any payments herein required to be made at the time of closing shall be by certified check or cashier's check, payable to the City of Evanston.
