Geier and Candace Cohn for a variation from the permitted use regulations to permit use of a portion of an existing accessory building for a piano studio and installation of an air conditioning unit in conjunction therewith within ten feet of the North property line on the property located at 1500 Asbury Avenue, in an R1 Single -Family Residence District; said public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for a variation from the permitted use regulations�o permit use of a portion of an existing accessory building for a piano studio be granted and that the request for • variation to permit the installation of an air conditioning unit be denied. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearing, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 88-19-V(R), the application of Joel S. Geier and Candace Cohn for a variation from the permitted use regulations to permit use of a portion of an existing accessory building for a piano studio on the property located at 1500 Asbury Avenue legally described as follows: That part of Lot 5 lying South of a line described as • follows: commencing at a point on the East line of said Lot 5, 60 feet South of the Northeast corner of said Lot 5; thence West on a line parallel with the North line of said Lot 5, 135.18; thence North 5 feet; thence West parallel with the North line of said Lot 5, 45 feet to the West line of said Lot 5, together with Lot 4 (except the I - South 1 foot thereof) all in block 57 in the Village (now City) of Evanston, in Section 13, Township 41 North, Range 13, East of the Third Principal Meridian, in Cook County, Illinois. is granted, subject to compliance with all other provisions of the Zoning Ordinance and other applicable laws and the • following conditions: 1. The proposed improvements shall be made in substantial compliance with the testimony presented and the plans placed on file in conjunction with 'this case, except for the air conditioning unit depicted on said plan; 2. Use of the piano studio or practice room shall be limited solely to residents of the same zoning lot; 3. A covenant of agreement to the above terms and conditions shall be prepared by the applicant for. review by the City Law Department, and upon approval, shall be executed and recorded by the applicant and a copy of said recorded covenant shall be furnished to the City Department of Building and Zoning. SECTION 2: That, based upon the application, submitted documents, testimony and upon the deliberations and findings contained in the transcript of the hearing,' the application of Joel S. Geier and Candace Cohn for a variation from the general yard regulations of the Zoning • Ordinance to permit an air-conditioning unit in conjunction with the aforementioned piano studio within ten feet of the north property line on the property located at 1500 Asbury Avenue, is denied. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. Introduced: (_ C,;L%� 72 1988. Adopted: _04. 1988.
