HomeMy WebLinkAboutORDINANCES-1988-040-O-88pu 5/26/88 • 0 AN ORDINANCE Granting_a Special Use at 825 Church Street WHEREAS, the Evanston Zoning Board of Appeals conducted a public hearing on May 17, 1988 upon the application of Centrum Properties, Inc., as beneficiary under. the LaSalle National Bank of Chicago, Trust 106506, for a special use to permit establishment of a Type 2 Restaurant at 825 Church Street, property located in a B5 Business District; said public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said special use be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: " SECTION 1: That, based upon the evidence and testimony presented at the hearing, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of appeals Case No. 88-9-SU(R), the application of Centrum Properties, Inc., as beneficiary under the LaSalle National Bank of Chicago, Trust 106506, for a special use to permit establishment of a Type 2 Restaurant at 825 Church Street, property located in a B5 Business District and legally described as follows: Lots Seven (7) to Thirteen (13), both inclusive, in the Resubdivision of Block Seventeen (17) in Evanston in the Northwest 1/4 of Section 18, Township 41 North,, Range 14 East of the Third Principal Meridian, in Evanston, Cook County, Illinois is granted, subject to compliance with all other provisions of the Zoning Ordinance, other applicable laws and the following conditions: • 1. Said Type 2 Restaurant shall be installed and operated in substantial compliance with the testimony presented and the plans placed on file in connection -1- i • is 40-0-88 i with this case; 2. Said Type 2 Restaurant shall be limited solely tq the serving of bakery goods, including cold or baked sandwiches, soft drinks, coffee, tea and juices, and that such service for consumption on the premises shall .be by use of non -disposable flatware and dishware; 3. No amusement devices, as defined in Section 3-8-1 of the City Code, shall be established or maintained within said Type 2 Restaurant; and 4. An anti -littering sign and identification of said restaurant as a Type 2 restaurant shall be permanently displayed within the establishment. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage,. approval, and publication in the manner provided by law.
