AN ORDINANCE
Granting a Special Use Permit
at 2516-22 Green Bay Road
WHEREAS, the Evanston Zoning Board of Appeals (ZBA)
. conducted a public hearing on November 21, 1989, upon the
application of The 2516 Green Bay Limited Partnership as
beneficiary under the Harris Bank of Wilmette, Trust Number
L3580 and Illinois Franchise Associates for a special use to
permit establishment of a type 2 restaurant without a drive-in
facility on property located at 2516-22 Green Bay Road, in a C2
Commercial District; said public hearing having been conducted
pursuant to notice and publication thereof in the manner
prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said special use be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That, based upon the evidence and
testimony presented at the hearing, and
upon deliberations and findings of fact contained in the
transcript of the Zoning Board of Appeals Case No. 89-35-SU(R),
the application of The 2516 Green Bay Limited Partnership as
beneficiary under the Harris Bank of Wilmette, Trust Number
L3580 and Illinois Franchise Associates for a special use to
permit establishment of a type 2 restaurant without a drive-in
facility on property located at 2516-22 Green Bay Road, in a C2
Commercial District; and legally described as follows:
LOTS 5 AND 6 IN BLOCK 16 IN NORTH EVANSTON, BEING A
).,`SUBDIVISION OF PART OF SMITH'S SUBDIVISION OF THE SOUTH
PART OF QUILMETTE RESERVE IN SECTION 12, TOWNSHIP 41
NORTH, RANGE 13 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN
COOK COUNTY, ILLINOIS, COMMONLY KNOWN AS 2516-22 GREEN
BAY ROAD, EVANSTON, ILLINOIS.
is granted, subject to compliance with all other provisions of
athe Zoning Ordinance, other applicable laws and the following
conditions:

1. The subject type 2 restaurant shall be established
in substantial compliance with the testimony
presented and the plans placed on file in
connection with this case; and
2. Said type 2 restaurant shall be limited solely to
the serving of yogurt type products and non-
alcoholic beverages.
3. The following litter collection plan shall be
instituted by the applicant: (a) two refuse
containers shall be placed near the exit doors
from the establishment, (b) once daily litter of
all types shall be picked up along Green Bay Road
between Lincoln Street on the south and Harrison
Street on the north, and (c) litter of all types
On the premises and the immediately abutting Green
Bay Road frontage shall be picked up once an hour
when the store is open and operating.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect form and after its passage,
approval and publication in the manner provided by law. I
