HomeMy WebLinkAboutORDINANCES-1989-147-O-89- "v UJ 1-12-90 2-22-90 f 1.47-0-89 AN ORDINANCE Granting a Special Use Permit at 2520 Gross Point Road WHEREAS, the Evanston Zoning Board of Appeals (ZBA) • conducted a public hearing on October 17, 1989 and November 21, 1989, upon the application of F. Quentin Brown and Ross S. Brown, contract purchasers, for a special use to permit construction of a ninety-nine bed sheltered care home on the property located at 2520 Gross Point Road, in a B1 Business District; said public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said special use be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearing, and 40 upon deliberations and findings of fact contained i in the transcript of the Zoning Board of Appeals Case No. 89-30-SU(R), the application of F. Quentin Brown and Ross S. Brown, contract purchasers, for a special use to permit construction of a ninety-nine bed sheltered care home on the property located at 2520 Gross Point Road, in a B1 Business District and legally described as follows: THAT PART OF LANDECKS DIVISION OF LOT 2 OF EVERT AND SCHOEFER'S SUBDIVISION OF PART OF THE NORTHEAST FRACTIONAL QUARTER OF SECTION 10, TOWNSHIP 41 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF SAID LANDECKS DIVISION, BEING THE NORTH LINE OF A PRIVATE ROAD AND THE WEST LINE OF A PRIVATE ALLEY, THENCE EASTERLY ALONG THE NORTH LINE OF SAID LANDECKS DIVISION 379.92 FT. TO THE NORTHEAST CORNER OF SAID LANDECKS DIVISION, THENCE SOUTHERLY ALONG THE EASTERLY LINE OF LANDECKS DIVISION, BEING THE WESTERLY LINE OF GROSS POINT ROAD, 312.44 FT. TO THE SOUTHEAST CORNER OF LOT 8 IN LANDECKS DIVISION, THENCE NORTHWESTERLY ALONG THE SOUTHERLY LINE OF SAID LOT 8 AND ITS PROJECTION, 185.80 FT., THENCE WESTERLY 51.82 FT. TO A POINT ON THE WESTERLY LINE OF LANDECKS DIVISION, 128.99 FT. SOUTH OF THE NORTHWEST CORNER OF LANDECKS DIVISION, THENCE NORTHERLY ALONG THE WEST LINE OF LANDECKS DIVISION 1 147-0-89 128.99 FT. TO THE POINT OF BEGINNING, ALL IN COOK COUNTY, ILLINOIS. is granted, subject to compliance with all other provisions of the Zoning Ordinance, other applicable laws and the following conditions: • 1. The proposed construction, operation and patient population of the sheltered care home shall be in substantial compliance with the testimony presented and the plans placed on file in connection with this case and any changes in the proposed ccnstruction, operation or patient population of the proposed facility which are not in substantial compliance with the testimony presented by applicant, or which necessitate an amendment to the Certificate of Need, dated June 2, 1989, issued by the Illinois Health Facilities Planning Board with respect to this facility or the issuance of a new Certificate of Need by said Health Facilities Planning Board shall terminate this Special Use and necessitate a reapplication for a new Special Use pursuant to the applicable regulations and procedures set forth in the Evanston Zoning Ordinance; 2. The proposed front canopy shall have a minimum height of 12 feet in order to allow emergency vehicle access; 3. A fire hydrant shall be placed in the rear parking area at a location acceptable to the Fire Prevention Bureau; 4. An access easement shall be provided over the northernmost driveway, in order to provide access is to the City standpipe; 5. The applicant shall dedicate the ten (10) feet of the easternmost portion of the lot adjacent to the Gross Point road right-of-way for street purposes; 6. Landscaping shall be installed on the site, and the plan for said landscaping shall be subject to review and approval by the Site Plan Review Committee, prior to issuance of any building permits for the proposed construction; 7. The subject property shall be consolidated into one lot prior to the issuance of any permits for construction; 8. In the event there is a final determination by a court of competent jurisdiction, from which no appeal can be taken, of a violation of any Ordinance, Regulation, or Statute of the City of Evanston, the State of Illinois or the Federal Government as a result of the maintenance or operation of the facility, the Special Use shall terminate; 9. Upon determination by the Director of Building and Zoning that there are violations of the conditions set forth in this ordinance, the special use herein shall terminate; 2 I 147-0-89 0 • 11 • 10. The applicant shall prepare a covenant of agreement to run with the land, agreeing to the above terms and conditions; the covenant shall provide that if other uses are established, that said uses shall be in conformance with uses which are permitted under the Zoning Ordinance, and said covenant shall be in a form acceptable to the Corporation Counsel, and a copy of the recorded covenant shall be provided to the City Building and Zoning Department. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
