HomeMy WebLinkAboutORDINANCES-1989-139-O-89i 10/31/89 11/8/89 11/14/89 11/16/89 11/29/89 I� 139-0-89 AN ORDINANCE • f AUTHORIZING THE CITY MANAGER TO ENTER INTO CONTRACT FOR THE SALE OF A PORTION OF PARKING LOT 3 AND TO ENTER INTO A CONTRACT FOR THE PURCHASE OF A PORTION OF 615 CHURCH STREET • • WHEREAS, the City of Evanston owns the real property commonly known as a portion of Parking Lot 3, legally described as follows: The South 31 ft. of Lot 13 (except the West 40 ft. thereof) in Block 15 of Village (now city) of Evanston, in the Northeast quarter of fractional Section 18, Township 41 North, Range 14, East of the Third Principal Meridian, in Cook ; County, Illinois. I WHEREAS, the City Council of the City of Evanston has (determined that ownership of said portion of Parking Lot 3 is no longer necessary, appropriate, required or in the best interest l Hof the City of Evanston; and I WHEREAS, the City Council of the City of Evanston has determined that the best interest of the City of Evanston would be served by the sale of said portion of Parking Lot 3 to a qualified party for private use; and WHEREAS, pursuant to Ordinance 132-0-89, the City Council by a vote of 2/3 of the elected Aldermen then holding !office did direct that the process to sell said Property be by �Inegotiation and that the City Manager be authorized to (negotiate on behalf of the City; and WHEREAS, pursuant to said ordinance said negotiations �ihave occurred; and 1 • LJ !I WHEREAS, the notice of intent to sell City property has f been published in a newspaper of general circulation in the City is lof Evanston as required by ordinance; WHEREAS, the Evanston Women's Club is desirous of selling, and the City of Evanston as part of the negotiated sale !of the hereinabove described portion of Parking Lot 3 is i desirous of purchasing, a certain portion of the property known I as 615 Church Street, Evanston, Illinois, legally described as follows: 4 See Exhibit A ;I WHEREAS, acquisition by the City of said property is essential to accommodate a new and expanded public library } building; WHEREAS, a real estate sales contract has been negotiated by the parties for the sale of said portion of Parking Lot 3 to The Evanston Women's Club and the purchase of said portion of 615 Church Street by the City and the payment to The Evanston Women's Club of one hundred thousand dollars ($100,00.00) . i WHEREAS, the terms of the aforesaid agreement by which the City of Evanston would acquire the property described in Exhibit A are accepted by the City as a compromise in order to avoid litigation; and WHEREAS, the City Council finds and determines that the best interest of the City of Evanston and its residents will be i served by the acceptance of the aforesaid contract on j i substantially the terms and conditions as set forth in Exhibit A j which is attached hereto and incorporated hereby reference; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF I THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: I • SECTION 1: The City Council of the City of Evanston I !i finds as fact the recitals hereinabove i set forth. 0 • E SECTION 2: The negotiated sale to the Evanston Women's Club, as buyer, of the property described !as The South 31 ft. of Lot 13 (except the West 40 ft. thereof) in Block 15 of Village (now city) of Evanston, in the Northeast quarter of fractional SEction 18, Township 41 North, i Range 14, East of the Third Principal Meridian, in Cook County, Illinois. I �lis hereby approved by the City Council of the City of Evanston, I and the purchase by the City from the Evanston Women's Club of i ;the property legally described as See Exhibit A its hereby, approved by the City Council. I I SECTION 3: The City Manager is hereby authorized li and directed to sign, and the City Clerk ilis hereby authorized and directed to attest, the contract for !I the sale of a portion of Parking Lot 3 and the purchase of a portion of 615 Church Street, which contract shall be in ('substantial accordance with the attached Exhibit B. The City (Manager is further authorized to negotiate any changes or (additional terms and conditions with respect to the sale of the I aforesaid real property as he may deem fit and proper. SECTION 4: The City Manager and the City Clerk, respectively, are hereby authorized and directed to execute, attest and deliver such other documents, jagreements and certificates as may be necessary to the sale (herein authorized, including other documents referred to in said (contracts. SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
