AN ORDINANCE
Granting a Special Use Permit
at 1239-47 Pitner Avenue
WHEREAS, the Evanston Zoning Board of Appeals conducted
a public hearing on September 19, 1989, upon the application of
the Reed L. Beidler Family Limited Partnership, as beneficiary
under the LaSalle National Bank of Chicago, Trust 101306 (owner)
and Arthur R. Lipar (prospective lessee) for a special use to
permit use of the property for a Christmas tree sales lot from
November 25 through December 24, of each calendar year, on the
property located at 1239-47 Pitner Avenue, property located in
an R2 Single-family Residence District; said public hearing
having been conducted pursuant to notice and publication thereof
in the manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said special use be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
• SECTION 1: That,.based upon the evidence and
testimony presented at the hearing, and
upon deliberations and findings of fact contained in the
transcript of the Zoning Board of Appeals Case No.
89-31-SU(R), the application of the Reed L. Beidler Family
Limited Partnership, as beneficiary under the LaSalle National
Bank of Chicago, Trust 101306 (owner) and Arthur R. Lipar
(prospective lessee) for a special use to permit use of the
property for a Christmas tree sales lot from November 25 through
December 24, of each calendar year, on the property located at
1239-47 Pitner Avenue, property located in an R2 Single-family
Residence District and legally described as follows:
LOTS 44, 45, 46, 47 AND 48 IN "RUTT"S RESUBDIVISION" OF
BLOCK 1 IN PITNER AND SON'S"THI+RD ADDITION TO EVANSTON,
BEING A SUBDIVISION OF THE NORTHWEST QUARTER OF THE
• NORTHWEST QUARTER OF SECTION 24, TOWNSHIP 41 NORTH,
RANGE 13 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK
COUNTY, ILLINOIS."

is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the following
conditions:
1. The hours of operation of said Christmas tree
sales lot shall be limited to 9:00 A.M. to 10:00
P.M. daily;
• 2. No cutting, burning or trimming of trees or wood
shall be permitted on the property;
3. Delivery of trees to the premises shall be limited
to no more than two a season and said deliveries
shall be made during daytime hours;
4. There shall be no public address system on the
premises for the broadcast of music;
5. The property owner, who also owns the parking lot
adjacent to the east, shall make ingress and
egress available from Hartrey Avenue for service
of the subject Christmas tree sales lot;
6. There shall be no'more than one advertising sign
placed on the premises and said sign shall conform
to the Sign Ordinance of the City of Evanston;
7.'The subject parking lot shall be kept weed free
or mowed when it is not being used as a Christmas
tree sale lot;
8. The special use granted herein shall terminate at
such time as the parking lot in question is
necessary to supply required parking for the
building at 2100 Dempster Street.
• SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect form and after its passage,
approval and publication in the manner provided by law.
