HomeMy WebLinkAboutORDINANCES-1989-098-O-897-31-89 8-16-89 9-7-89 AN ORDINANCE Granting a Variation and a Special Use Permit at 1704 Central Street WHEREAS, the Evanston Zoning Board of Appeals conducted • a public hearing on July 18, 1989, upon the application of Jacob U Kaplan and Julius Kaplan, as beneficiaries under the Chicago Title and Trust Company, Trust 32830, and Merlin's products, I.nc. d/b/a "Munch a Bunch" (prospective lessee), for variation from the off-street parking regulations of the Zoning Ordinance, and for a special use to permit establishment of a type 2 restaurant without supplying the net increase of one off-street parking space on the property located at 1704 Central Street, Evanston, Illinois, located in a B2 Business District; said public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said variation and special use be granted; • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearing, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 89-15-V&SU(R) the application of Jacob Kaplan and Julius Kaplan, as beneficiaries under the Chicago Title and Trust Company, Trust 32830, and Merlin's products, Inc. d/b/a "Munch a ' Bunch" (prospective lessee), for variation from the off-street parking regulations of the Zoning Ordinance, and for a special use to permit establishment of a type 2 restaurant without supplying the net increase of one off-street parking space on . the property located at 1704 Central Street, Evanston, Illinois, and legally described as follows: 1 Lots 6, 7,8, 9 and 10 in Block 9 in North Evanston, in Section 12, Township 41 North, Range 13, East of the Third Principal Meridian, in Cook County, Illinois. is granted, subject to compliance with all other provisions of ` the Zoning Ordinance, other applicable laws and the following I conditions: • I 1. The proposed type 2 restaurant shall be established in substantial conformance with the plans placed on file and the testimony presented in connection with this case; 2. Said type 2 restaurant shall be limited solely to the serving of ice cream, soft serve and frozen yogurt and custards, soups, salads, sandwiches, baked goods and non- i alcoholic beverages; 3. No fried or deep-fried food shall be prepared or served within said type 2 restaurant; 4. No amusement devices, as defined in Section 3-8-1 of the City Code, shall be installed or maintained within said type 2 restaurant; 5. Said type 2 restaurant shall be limited to a maximum of I fifteen (15) seats; 6. Said type 2 restaurant shall be subject to the following litter collection plan: a. A non -spillable waste receptacle shall be installed outside of said restaurant and said receptacle shall be emptied a minimum of once every two hours and just before closing when said restaurant is open; b. At least once every two hours when said restaurant is • open, and just before closing, the restaurant operator shall arrange for litter of all types, from whatever source, to be collected on (1) both sides of Central Street from Eastwood Avenue, west to 1729 Central Street (2) the south side of Central Street east to 1612-22 Central Street, and (3) both sides of Eastwood Avenue, south of Central Street, to the first alley running east and west, south of Central Street; • SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, K, approval and publication in the manner provided by law.
