HomeMy WebLinkAboutORDINANCES-1989-093-O-89AN ORDINANCE Granting a Planned Development to Permit Construction at 2500-22 Crawford Avenue, 3401-3513 Harrison Street and 2531-75 Gross Point Road • WHEREAS, the Evanston Zoning Board of Appeals conducted a public hearing on July 11, 1989, upon the application of Optima Evanston Limited Partnership as beneficiary under the American National Bank and Trust Company of Chicago, Trust No. 10792604 for planned development to permit construction of four buildings containing a total of 123 dwelling units on the property located at 2500-22 Crawford, 3401-3513 Harrison Street and 2531-75 Gross Point Road, Evanston, Illinois, located in an R5 General Residence District and a B1 Business District; said public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said planned development be granted; ,y NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF • THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearing, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals,Case No. 89-18-PD(R) the application of Optima Evanston Limited Partnership as beneficiary under the American National Bank and Trust Company of Chicago, Trust No. 10792604 for planned development to permit construction of four buildings containing a total of 123idwelling units on the property located at 2500-22 Crawford, 3401-3513 Harrison Street and 2531-75 Gross Point Road, Evanston, Illinois and legally described as follows: "PARCEL 1: LOTS 1 TO 21, INCLUSIVE, AND LOTS 30 TO 32, INCLUSIVE AND LOT 34 (EXCEPT THE EAST 10 FEET OF SAID LOTS 1 AND 34, TAKEN FOR CRAWFORD AVENUE) IN HIGHLANDS • TERMINAL, BEING A SUBDIVISION IN THE NORTHEAST FRACTIONAL QUARTER OF FRACTIONAL SECTION 10, TOWNSHIP 41 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS. 1 y3-O-89 ALSO ALL THE VACATED 20 FOOT PUBLIC ALLEY RUNNING IN AN EAST AND WEST DIRECTION LYING NORTH OF AND ADJOINING LOTS 1 TO 21 AFORESAID, INCLUSIVE, AND SOUTH OF AND ADJOINING LOT 34 AFORESAID, WHICH LIES EAST OF THE NORTHWESTERLY LINE OF LOT 34 AFORESAID, EXTENDED SOUTHWESTERLY TO THE NORTHWESTERLY LINE OF LOT 20 AFORESAID, AND LYING WEST OF THE WEST LINES EXTENDED OF THE EAST 10 FEET OF LOTS 1 • AND 34 AFORESAID; ALSO ALL OF THE NORTHWESTERLY HALF OF THE VACATED 20 FOOT PUBLIC ALLEY RUNNING IN A NORTHEASTERLY AND SOUTHWESTERLY DIRECTION LYING SOUTHEASTERLY OF AND ADJOINING LOTS 30 AND 32 AFORESAID, INCLUSIVE, AND ALL OF THAT PART OF THE SOUTHEASTERLY HALF OF SAID VACATED PUBLIC ALLEY LYING NORTHEASTERLY OF THE SOUTHWESTERLY LINE OF LOT 30 AFORESAID, EXTENDED SOUTHEASTERLY AND NORTHWESTERLY OF AND ADJOINING LOT 34 AFORESAID; PARCEL 2: LOTS 3 TO 24 INCLUSIVE, IN HIGHLANDS TERMINAL FIRST ADDITION, BEING A SUBDIVISION OF LOT 1 (EXCEPT THE EAST 25 FEET) IN KETTER AND EVERT'S SUBDIVISION OF PART OF THE NORTHEAST FRACTIONAL QUARTER OF FRACTIONAL SECTION 10, TOWNSHIP 41 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN, TOGETHER WITH LOT 33 IN HIGHLANDS TERMINAL AFORESAID; ALSO ALL THAT PART OF THE NORTHWESTERLY HALF OF THE VACATED 20 FOOT PUBLIC ALLEY RUNNING IN A NORTHEASTERLY AND SOUTHWESTERLY DIRECTION LYING SOUTHWESTERLY OF AND ADJOINING LOTS 7 TO 24 IN HIGHLANDS TERMINAL FIRST ADDITION AFORESAID; • 1I PARCEL 3: LOT 35 IN THE RESUBDIVISION OF LOTS 25 TO 34 (EXCEPT THE EAST 10 FEET DEDICATED FOR CRAWFORD AVENUE) TOGETHER WITH LOT 35 AND VACATED ALLEY BETWEEN LOTS 25 TO 34 AND LOT 35 IN HIGHLANDS TERMINAL FIRST ADDITION AFORESAID; ALSO THE SOUTHEASTERLY HALF OF THE VACATED.20 FOOT PUBLIC ALLEY RUNNING IN A NORTHEASTERLY AND SOUTHWESTERLY DIRECTIONS AND LYING NORTHWESTERLY OF AND ADJOINING THE NORTHWESTERLY LINE OF LOT 35 AFORESAID, AND SAID LINE EXTENDED NORTHEASTERLY AND ALL THAT PART OF THE VACATED PUBLIC ALLEY LYING NORTH OF AND ADJOINING THE NORTH LINE OF LOT 35 AFORESAID AND SOUTHEASTERLY OF THE NORTHWESTERLY LINE OF SAID LOT 35 EXTENDED NORTHWESTERLY, BOTH OF SAID PARTS LYING WEST OF THE EAST LINE OF SAID LOT 35, EXTENDED NORTH, AS VACATED BY AN ORDINANCE RECORDED JANUARY 10, 1957 AS DOCUMENT 16798977, ALL IN THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS." is granted, subject to compliance with all other provisions of the Zoning Ordinance, other applicable laws and the following • conditions: 1. The proposed construction shall conform with the testimony presented and the plans and other documents placed on file in connection with this case, except that minor changes from said plans, testimony and documents 2 shall be allowed, provided that such changes are approved by the City Manager, after consultation with the Site Plan Review Committee or its designated subcommittee; 2. The proposed Declaration of Condominium Ownership and of easements, restrictions and covenants shall be subject to review and approval of the City staff prior to recording; is 3. The subject property shall be consolidated into one lot prior to the issuance of any building permits; 4. The lot to be created by the consolidation required in the preceding condition shall be held as a condominium, cooperative or by means of any other arrangement by which the land would remain under single ownership and no subdivision of said consolidated lot shall be undertaken in the future without prior City approval; 5. The proposed buildings shall be set back from the street lot lines as follows: 48 feet from Crawford Avenue, 27 feet over the easternmost 122 feet adjacent to Harrison Street and 24 feet over the remainder of the Harrison Street frontage and 18 feet from Gross Point Road; 6. No fences, recreational equipment or other structures shall be erected in the setbacks defined in the preceding condition, except for structures determined by the Site Plan Review Committee to constitute desired public amenities which also are approvable as a minor change per condition one of this report; 7. The applicant shall prepare a covenant to run with the land, citing the above terms and conditions • and a copy of said covenant shall be provided to the City Building and Zoning Department after recording. e SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect form and after its passage, approval and publication in the manner provided by law.
