HomeMy WebLinkAboutORDINANCES-1989-079-O-8979-0-89 AN ORDINANCE Amending Section 7-4-1 of the Code of the City of Evanston, Relating to the Excavation of Public Property BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, • COOK COUNTY, ILLINOIS • SECTION 1: That Section 7-4-1 of the Code of the City of Evanston, 1979, as amended, be and hereby is further amended by adding the following: 7-4-1-A: PERMIT REQUIRED; FEES, BOND, INSURANCE: No permit for the making of any opening, hole or excavation in a public street, alley, sidewalk, parkway or public property shall be issued for the purpose of installing an underground sprinkler system until all fees therefor shall have been paid in full and either (1) an indemnity bond in the penal sum of twenty-five thousand dollars ($25,000.00) shall have been filed with the City to protect and hold it free and harmless from all claims or rights of action arising from or claimed to be due to the making, existence, or replacement of such underground sprinkler system, or (2) proof of applicant's liability insurance in the amount of three hundred thousand dollars ($300,000.00), naming the City of Evanston as additional insured, to be in effect as long as the underground sprinkler system exists. Such proof of insurance shall be accompanied by an agreement executed by the applicant indemnifying and holding the City harmless from all liability for damages or expenses resulting from or by reason of issuing of the required permit for construction of an underground sprinkler system. Applicants will be responsible for notifying the City Clerk in writing at least thirty (30) days prior to the transfer of their property and interest in the public way. Further, should there be any improvement to the public way upon which the underground sprinkler system is located, it will be the responsibility of the applicant or their successor(s) to remove the underground sprinkler system at their own cost. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval, ands publication in the manner provided by law.
