�I AN ORDINANCE

• " Authorizing the Sale of
j' Certain Municipally -Owned Real Property
i
WHEREAS, The City of Evanston owns the real property commonly
I; known as Parking Lot 41, located at 726 Reba Place, in the City of Evanston,
legally described as follows and hereinafter referred to as the "Property".
;
Lot seven (7) in Block two (2) in Green and Hubbard's Subdivision of the
North twelve and forty-six one hundredths (12.46) acres of Lot nine (9)
of Assessor's Division of the South half of the South West quarter of
Section nineteen (19), Township forty-one (41) North, Range Fourteen (14)
East of the Third Principal Meridian in Cook County, Illinois.
WHEREAS, the City Council of the City of Evanston has determined
fi that ownership of the Property is no longer necessary, appropriate, required

or in the best interest of the City of Evanston; and

WHEREAS, the City Council of the City of Evanston has determined
j that the best interest of the City of Evanston would be served by the sale of
I
Ii said Property to a qualified party for its private use; and

I! WHEREAS, pursuant to Ordinance 74-0-87 of the City of Evanston j
l
adopted August 10, 1987, the City Council by a vote of 2/3 of the elected
;
Aldermen then holding office did direct that the process to sell said Property
j
shall be by negotiation and that the City Manager shall be authorized to
negotiate on behalf of the City; and
WHEREAS, pursuant to said ordinance said negotiations have
occurred; and
jj WHEREAS, the City Manager recommends that a sale between the

• City of Evanston, as seller, and Parbell Associates, as buyer, be accepted by
the City. Said contract is marked as Exhibit A, attached hereto and

incorporated herein by reference; and

WHEREAS, the City Council finds and determines that the best
interest of the City of Evanston and its residents will be served by the
acceptance of the aforesaid contract on the terms as set forth in attached
Exhibit A; and

WHEREAS, the notice of intent to sell has been published in a
newspaper of general circulation in the City of Evanston as required by
ordinance;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: The City Council of the City of Evanston finds as
fact the recitals hereinabove set forth.
SECTION 2: The negotiated sale to the Parbell Associates, as
buyer, attached as Exhibit A hereto, is hereby
• accepted by the City Council of the City of Evanston for the following
,described real property:
Lot seven (7) in Block two (2) in Green and Hubbard's Subdivision of the
North twelve and forty-six one hundredths (12.46) acres of Lot nine (9)
of Assessor's Division of the South half of the South West quarter of
Section nineteen (19), Township forty-one (41) North, Range Fourteen (14)
East of the Third Principal Meridian in Cook County, Illinois.
commonly known as Parking Lot 41, located at 726 Reba Place.
SECTION 3: The City Manager is hereby authorized and directed to
sign, and the City Clerk is hereby authorized and
directed to attest, the contract for the sale of the aforesaid real property,
which contract shall be in accordance with attached Exhibit A. The City
Manager is further authorized to negotiate any changed or additional terms and
conditions with respect to the sale of the aforesaid real property as may be
deemed fit and proper.

SECTION 4: The City Manager and the City Clerk, respectively,
• are hereby authorized and directed to execute,
attest and deliver such other documents, agreements and certificates as may be
necessary to the sale herein authorized, including other documents referred to
in said contracts.
SECTION 5: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 6: This ordinance shall be in full force and effect
from and after its passage, approval, and
publication in the manner provided by law.
