AN ORDINANCE
Granting a Variation from the Use Regulations

at 2100 Dempster Street
WHEREAS, the Evanston Zoning Board of Appeals
conducted a
public
hearing
on March 21, 1989, upon the
application
of the
Beidler
Family Limited Partnership, as
{ beneficiary, under the LaSalle National Bank, Trust No. 101306,
and Central Evanston Child Care, Inc., prospective lessee, for
variation from the use regulations of the Zoning Ordinance to
permit establishment of a child care institution serving a
maximum of 158 children at any one time, between the ages of 6
weeks and 5 years, in the existing building on the property

located at 2100 Dempster Street, Evanston, Illinois in an M3
Restricted Manufacturing District; said public hearing having
been conducted pursuant to notice and publication thereof in
i
the manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said variation be granted;
. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That, based upon the evidence and
testimony presented at the hearing, and
upon deliberations and findings of fact contained in the
transcript of the Zoning Board of Appeals Case No. 89-2-V(R),
the application of the Beidler Family Limited Partnership, as
beneficiary, under the LaSalle National Bank, Trust No. 101306,
and Central Evanston Child Care, Inc., prospective lessee, for
variation from the use regulations of the Zoning Ordinance to
permit establishment of a child care institution serving a
maximum of 158 children at any one time, between the ages of 6
weeks and 5 years, in the existing building on the property
located at 2100 Dempster Street, Evanston, Illinois and legally

That portion of the North half of the Northeast quarter of
the Northwest quarter of Section 24, Township 41 North,
Range 13 East of the Third Principal Meridian lying west
of the right of way of the Chicago and Northwestern
railway (except the North 33.0 feet thereof and except the
West 33.0 feet thereof dedicated for streets ... AND...Lots
1, 2, 3, and the North half of Lot 4, Lot 23 (except the
South 7.0 feet thereof), all of Lot 24, together with the
Vacated Alley lying between said Lots 1, 2, 3, 22, 23, and
24; and Vacated Crain Street lying North of and adjoining
said Lots 1 and 24, and that part of Vacated Grey Avenue
lying East of and adjoining said Lots 1, 2, and 3 and the
North half of Lot 4 and Westerly of the right of way of
the Chicago and Northwestern Railway, all in Block 2 of
Grover and Pitner's Addition to Evanston, a subdivision of
the Southwest quarter of the Northeast quarter of the
Northwest quarter of Section 24, Township 41 North, Range
13 East of the Third Principal Meridian, in Cook County,
Illinois.
is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the following
condition:
1. The proposed construction shall be in substantial
compliance with the testimony presented and the
revised plans placed on file at the hearing as
Applicant's Exhibits 2 and 3 in connection with this
case;
2. The arrangement for vehicular drop-off and pick-up of
children served by the child care institution, shall
be subject to review and approval by the City Traffic
Engineer;
3. The exit from the child care institution facing on
Dempster Street shall be used by the staff when
• conducting children to or from the building for
walking trips when the destination is not a vehicle;
and
4. The parking area adjacent to the east of the subject
building shall be used by all persons seeking ingress
or egress to said facility from a motor vehicle.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
approval, and publication in the manner provided by law.
