HomeMy WebLinkAboutORDINANCES-1989-034-O-892-2/-8y 34-0-89 AN ORDINANCE Granting Variations and Special Use at 1316 Oakton Street WHEREAS, the Evanston Zoning Board of Appeals • conducted a public hearing on February 21, 1989, upon the application of the ABT Corporation for variations from the lot area and off-street parking regulations of the Zoning Ordinance and for a special use to permit conversion of the existing building into eight dwelling units, some of which would be partially or wholly located below the second floor and installation of seven off-street parking spaces to serve said dwelling units on property located at 1316 Oakton Street, Evanston, Illinois in a B1 Business District and R1 Single -Family Residence District; said public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said variations and special use be • granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearing, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 88-38-V & SU(R), the application of the ABT Corporation for variations from the lot area and off-street parking regulations of the Zoning Ordinance and for a special use to permit conversion of the existing building into eight dwelling units, some of which would be partially or wholly located below the second floor and installation of seven off-street parking spaces to serve said • dwelling units on property located at 1316 Oakton Street and legally described as follows: Part of the East Half of the North Half of the North Half of the North East Quarter of the North East Quarter of am s' 34-0-89 Section 25, Township 41 North, Range 13, East of the Third Principal Meridian, described as follows: Commencing at the Intersection of a Line 33.0 Feet South of and Parallel with the North Line of the North East Quarter of Said Section 25, with a Line 40 Feet West of and Parallel with the East Line of the North East quarter of said Section; Thence South along said North -South Parallel Line to the South Line of said North Half of the North Half of the North East Quarter of the North East Quarter of Section • 25; Thence West along said South Line to the Point of Beginning, being the North West Corner of Lot 1 in Block 3 in Kelly and O'Brien's South Evanston Subdivision of the South Half of the North Half of the North East Quarter of the North East Quarter of said Section: Thence North along the West.Line of said Lot 1, extended North, to a Point on a Line 16.0 Feet North of and Parallel'W"ith the North Line of said Lot 1; Thence East along said Parallel Line to a Point on a Line 201.02 Feet (As Measured Along Said Parallel Line) West of and Parallel with the East Line of the North East Quarter of Said Section: Thence North along said Parallel Line to a Point on a Line 185.014 Feet (As Measured Along Said Parallel Line) South of and Parallel with the North Line of the North East Quarter of said Section; Thence East Parallel with the North Line of the North East quarter of said Section, 30.65 Feet; Thence North Parallel with the East Line of the North East Quarter of said Section, 65.20 Feet; Thence West Parallel with the North Line of the North East Quarter of said Section, 1.65 Feet; Thence North Parallel with the East Line of the North East Quarter of said Section to a Point on a Line 33.0 Feet South of and Parallel with the North Line of the North East Quarter of said Section; Thence West along said Parallel Line 59.91 Feet; Thence South to a Point on the said South Line of the North Half of the North Half of the North East Quarter of the North East Quarter of Section 25, being 18.66 Feet West of the Point of Beginning; Thence East along said Line 18.66 Feet to • the Point of Beginning; PARCEL 2: That part of Lot 15 in Block 3 in Kelly and O'Brien's South East Evanston Subdivision of the South Half of the North Half of the North East Quarter of the North East Quarter of Section 25, Township 41,North, Range 13, East of the Third Principal Meridian, described as follows: Beginning at the South East Corner of said Lot 15 and running West along the South Line of said Lot 15, 20.00 Feet; Thence North along a Line Parallel with the East Line of said Lot 15, 10.00 Feet; Thence East on a Line Parallel with the South Line of Said Lot 15, 18.08 Feet, Thence North 23.32 Feet More or Less to a Point on the North Line of said Lot 15, 2.66 Feet West of the North East Corner of said Lot 15; Thence East on the North Line of said Lot 15, 2.66 Feet to the North East Corner, Thence South Along the East Line of said Lot 15 to the South East Corner thereof; all in Cook County, Illinois. is granted, subject to compliance with all other provisions of the Zoning Ordinance and other applicable laws, and the following conditions: • 1. A minimum of 7 off-street parking spaces shall be provided in conformance with all applicable regulations and conventions governing off-street -2- 34-0-89 parking and compliance of the plan with respect to off-street parking shall be determined by the City Traffic Engineer; 2. The proposed construction shall be in substantial compliance with the testimony presented and the plans, placed on file at the hearing; 3. A declaration of home ownership shall be recorded, • which shall obligate the owners of all of the units to provide for refuse pick-up and continued maintenance of the parking area; and 4. The applicant shall prepare a covenant to run with the land which will provide that one of the dwelling units will be occupied by persons,whb do not own or operate motor vehicles and a copy of said covenant shall be provided to the City Building and Zoning Department after recording. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
