HomeMy WebLinkAboutORDINANCES-1989-033-O-896 - L / - O J 3-2-89 3-20-89 33-0-89 AN ORDINANCE Granting a Special Use at 1739-43 Benson Avenue WHEREAS, the Evanston Zoning Board of Appeals • conducted a public hearing on February 21, 1989, upon the application of Nordon Investments Corporation as beneficiary under the Community Bank and Trust Company of Edgewater, Trust 88-01-452, for a special use to permit estab,li'hment of a Type 2 Restaurant within this business center at 1743 Benson Avenue, on property located in a B5 Business District; said public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said special use be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF` THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearing, and • upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 88-37-SU(R), the application of Nordon Investments Corporation as beneficiary under the Community Bank and Trust Company of Edgewater, Trust 88-01-452, for a special use to permit establishment of a Type 2 Restaurant within this business center at 1743 Benson Avenue and legally described as follows: The West 100 feet of Lots 18, 19 and Lot 17 except the East 55.19 Ft. of the North Half thereof in Northwestern University Resubdivision of Block 17 in Evanston, in Section 18, Township 41 North, Range 14, East of the Third Principal Meridian, in Cook County, Illinois. is granted, subject to compliance with all other provisions of the Zoning Ordinance and other applicable laws, and the following conditions: 1. The proposed Type 2 restaurant shall be installed in • substantial compliance with the testimony presented and the plans placed on file in connection with this case; 2. Said Type 2 restaurant shall be limited solely to the serving of yogurt products; mL 33-0-89 • • • 3. No fried or deep fried food shall be prepared or served within said Type 2 restaurant; 4. No amusement devices, as defined in Section 3-8-1 of the City Code, shall be established or maintained within said type 2 restaurant; 5. The serving hours of the subject Type 2 restaurant, shall be limited to 10 a.m. to 10 p.m. daily. 6. Inside trash receptacles shall be,placed by both exit doors to allow customers to discard litter before they exit the store; 7. During the daily peak period of 7`',p'.m. to 10 p.m., an employee shall collect all litter every half-hour within one-half block of the store in all directions, irrespective of whose litter it may be; 8. During non -peak periods, an employee shall pick up all litter within one-half block of the store in all directions every hour, irrespective of whose litter it may be; 9. Each morning, before opening, an employee shall pick up all litter within one-half block of the store, in all directions, irrespective of whose litter it may be; and 10. During the hours of darkness the preceding three conditions shall not be literally applicable, but the store operator shall use their best efforts to patrol the immediately surrounding area with due consideration for the safety of any employee so involved. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
