AN ORDINANCE
Granting a Special Use Permit
at 1939 Central Street
WHEREAS, the Evanston Zoning Board of Appeals (ZBA)
• conducted public hearings on August 21, 1990 and September 18,
1990, upon the application of George Holly and Michael Holly,
as beneficiaries under the First Illinois Bank of Wilmette Trust
TWB0683 (owners) and Alex Glukhovsky and Alena Glukhovsky
(franchisees), for a special use to permit establishment of a
type 2 restaurant, without a drive-in facility, on the property
located at 1939 Central Street, in a B2 Business District; said
public hearing having been conducted pursuant to notice and
publication thereof in the manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said special use be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
• SECTION 1: That, based upon the evidence and
testimony presented at the hearing, and
upon deliberations and findings of fact contained in the
transcript of the Zoning Board of Appeals Case No. 90-26-SU(R),
the application of George Holly and Michael Holly as
beneficiaries under the First Illinois Bank of Wilmette Trust
TWB0683 (owners), and Alex Glukhovsky and Alena Glukhovsky
(franchisees), for a special use to permit establishment of a
type 2 restaurant, without a drive-in facility, on the property
located at 1939 Central Street, in a B2 Business District and
legally described as follows:
LOT 3, 41 & 5 IN E.E. BETT'S RESUBDIVISION OF LOTS 8
& 9 IN BLOCK 21 IN NORTH EVANSTON IN THE SOUTH
SECTION OF OUILMETTE RESERVATION IN TOWNSHIP 42
NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL
MERIDIAN, IN COOK COUNTY, ILLINOIS,
• is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the following
conditions;

1. All deliveries to said type 2 restaurants shall be made
through the alley;
2. Food service by said type 2 restaurant to customers
shall be limited to 10:00 A.M. to 10:00 P.M., daily;
3. Said type 2 restaurant operator shall have litter of
all types collected a minimum of three times daily,
with one such collection being made following the
• closing of said store, on both sides of Central Street
between Stewart Avenue and Green Bay Road, all of
Independence Park, the south side of Livingston
Street, from Stewart Avenue to Prairie Avenue and the
west side of Prairie Avenue, from Central Street to
Livingston Street;
4. The owner or operator of the subject type 2 restaurant
shall not erect, install, display, inscribe, paint, or
affix any sign, lettering, or advertising medium to,
upon, or above the exterior of the subject restaurant
or the building in which said restaurant is situated,
nor to the surfaces of any entrance door or window,
except for a lettered sign bearing the restaurant's
name across the awning skirt in front of the subject
restaurant;
5. There shall be no changes in permanent signage, except
that the content of the current sign which is located
on the awning may be changed, provided that the new
sign shall consist of black painted letters;
6. The restaurant owner or operator will not permit the
accumulation of rubbish, trash, garbage or other refuse
in or around the subject premises and all refuse shall
be stored in approved containers;
• 7. The restaurant owner or operator shall not use or
permit the use of any equipment or apparatus producing,
reproducing, or transmitting sound which is audible
beyond the interior of the subject restaurant or permit
objectionable odors to emanate or be unreasonably
dispelled from the premises;
8. The facade of said type 2 restaurant shall be
maintained in an appearance similar to the facade of
the adjacent stores;
9. The menu of said type 2 restaurant shall be limited to
hot and cold sandwiches, salads, snack items, cookies
and hot and cold beverages;
10. No cooking shall take place in said type 2 restaurant,
except for bread -baking in electric convection ovens
and the heating of sandwiches in microwave ovens; and
11. In lieu of strict compliance with Section 6-12-10(B)4
of the Zoning Ordinance the applicant, with the
permission of the residential property owner, may
maintain the screening fence on the residential
property directly across the alley from the proposed
type 2 restaurant or, in the alternative, the applicant
shall install a fence on the subject property in
compliance with Section 6-12-10(B)4 of the Zoning
• Ordinance.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.

SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
approval and publication in the manner provided by law.
