AN ORDINANCE
Granting a Special Use Permit
at 1565 Sherman Avenue
• WHEREAS, the Evanston Zoning Board of Appeals (ZBA)
conducted a public hearing on July 17, 1990, upon the
application of Lawrence J. Starkman, as beneficiary under the
First Illinois Bank of Evanston, Trust No. R-3297, and Love's
Group, Inc., (lessee), for a special use to permit establishment
of a type 2 restaurant on the property located at 1565 Sherman
Avenue, in a B5 Business District; said public hearing having
been conducted pursuant to notice and publication thereof in the
manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said special use be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That, based upon the evidence and
• testimony presented at the hearing, and
upon deliberations and findings of fact contained in the
transcript of the Zoning Board of Appeals Case No. 90-17-SU(R),
the application of Lawrence J. Starkman, as beneficiary under
the First Illinois Bank of Evanston, Trust No. R-3297, and
Love's Group, Inc., (lessee), for a special use to permit
establishment of a type 2 restaurant on the property located at
1565 Sherman Avenue, in a B5 Business District and legally
described as follows:
LOT 9.IN BLOCK 27 IN THE VILLAGE OF EVANSTON, (NOW
CITY) IN SECTION 18, TOWNSHIP 41 NORTH, RANGE 14,
EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK
COUNTY, ILLINOIS.
is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the following
• conditions:
1. That the proposed restaurant shall be
established in substantial compliance with the
testimony presented and the plan placed on
file in connection with this case;

2. Said type 2 restaurant shall be limited solely
to the serving of frozen yogurt, garden salad,
salad platters, soup and chili, baked
potatoes, cookies, muffins, other snack items
and hot and cold beverages;
3. No fried or deep fried foods shall be prepared
or served within said type 2 restaurant;
4. No amusement devices, as defined in Section 3-
8-1 of the City Code, shall be established or
maintained within said type 2 restaurant; and
5. Twice daily, litter of all types shall be
collected by the restaurant tenant on both
sides of Sherman Avenue, between Grove Street
and Davis Street and the second daily
collection shall occur either after the
afternoon peak period or evening peak period
at the restaurant tenant's discretion.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
approval and publication in the manner provided by law.
