AN ORDINANCE
Adopting The One and Two Family Dwelling Code,
1989, and Amending Title 4, Chapter 11,
Sections 1, and 2
of the City Code of the City of Evanston
• WHEREAS, the City Council of the City of Evanston is desir-
ous of adopting certain criteria which will simplify the design and construc-
tion of one and two family buildings in the City of Evanston; and
WHEREAS, the One and Two Family Dwelling Code has been
authorized and copyrighted by the Building Officials and Code Administrators
International, Inc., the International Conference of Building Officials, and
the Southern Building Code Congress International; and
WHEREAS, the City Council of the City of Evanston has
caused three (3) copies of said code to be kept on file for a period of thirty
(30) days prior to the adoption of this ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Section 4-11-1(A) and (B) of the Code of
the City of Evanston, 1979, as amended, be
further amended to read as follows:
4-11-1: ADOPTION OF THE ONE AND TWO FAMILY CODE:

(A) Pursuant to the authority granted by Chapter 24, Section
1-2-4 of the Illinois Revised Statutes and pursuant to its
home rule powers, the City of Evanston hereby adopts by re-
ference the One and Two Family Code, 1989 Edition, which
code shall be used with the below -stated additions, amend-
ments, and deletions to govern the design and construction
of all detached one and two-family dwellings not more than
three stories in height and their accessory structures in
lieu of the code for use group R-3 structures in the
B.O.C.A. Basic Building Code.
(B) Any reference to "administrative authority," or "building
official" shall mean the Director of Building of the City
of Evanston. Any reference to "municipality" shall mean
the City of Evanston.
SECTION 2: That Section 4-11-1(C) be added to the City
Code of the City of Evanston, 1979, to read as
(A) Amendments: The following sections of the One and Two
Family Dwelling Code, are amended to read as follows:
Section R-110 Plans: An architect licensed in the State of
Illinois shall sign and seal, in accordance with State Law,
all building and remodelling where the total cost exceeds
ten thousand dollars ($10,000) or involves structural work
or new structures.
Exception: Unheated porches, decks, exterior stairs, non -
habitable detached garages and accessory buildings.
• Plans shall be drawn to scale and shall be of sufficient
clarity to indicate the nature and extent of the work pro-
posed and shall show in detail that it will conform to the
provisions of this code and all relevant laws, ordinances,

rules and regulations. Plans shall include a plot plan
drawn to scale showing the location of all easements,
drainage facilities, adjacent grades, property lines, the
proposed building and of every existing building on the
property.
Section R210.2 Emergency Egress Openings: Every habitable
room excluding kitchens and dining rooms shall have at
least one operable window or exterior door approved for
emergency egress or rescue.
The units must be operable from the inside to a full clear
opening without the use of separate tools. Where windows
are provided as a means of egress or rescue they shall have
a sill height of not more than 44 inches above the floor.
All egress or rescue windows from habitable rooms excluding
kitchens and dining rooms must have a minimum net clear
opening of 5.7 square feet. The minimum net clear opening
height dimension shall be 24 inches. The minimum net clear
opening width dimension shall be 20 inches.
Exceptions:
1. Grade and basement level windows may have a minimum net
clear opening of 5 square feet.
2. Emergency egress openings are not required in existing
basements when egress stairway meets requirements of
Section R213.
Section R-214.1 Handrails: Handrails having minimum and
maximum heights of 34 inches and 38 inches, respectively,
measured vertically from the nosing of the treads, shall be
provided on at least one side of stairways of three or more
risers and shall be continuous the full length of the
stairs and shall extend 6 inches beyond the top and bottom
risers. Ends shall be returned or shall terminate in newel
posts or safety terminals.

Open sides of stairs with a total rise of more than 30
inches above the floor or grade below shall have
guardrails. The handgrip portion of the handrails shall be
not more than 2 5/8 inches in cross -sectional dimension, or
the shape shall provide an equivalent gripping surface.
The handgrip portion of handrails shall have a smooth
surface with no sharp corners.
Handrails projecting from a wall shall have a space of not
less than 1 1/2 inches between the wall and the handrail.
Section R309.2 Access: An access crawl hole 18 inches by
24 inches shall be provided when clear height from grade to
underside of structure equals or exceeds 18 inches.
Part VII - Energy Conservation: The energy conservation
shall conform to B.O.C.A. National Energy Conservation Code
1990. Prefabricated housing units, except those in the
category of manufactured homes, otherwise known as mobile
homes, shall meet the requirements of this code section.
SECTION 3: That Section 4-11-2 of the code of the City of
Evanston, 1979, as amended, be further amended
• PENALTY: Any person who shall violate any provision of the
one and Two -Family Dwelling Code, 1989, as adopted, shall
be guilty of a violation punishable by a fine of not less
than fifty dollars ($50.00) nor more than five hundred

dollars ($500.00) for each and every offense. A separate
offense shall be deemed committed for each day that said
violation continues. (Ord. 81-0-84)
SECTION 4: It is the intention of the City Council that
the provisions of this ordinance and the One
and Two Family Dwelling Code, are severable and that the invalidity of any
section or part of any section of this ordinance and the code hereby adopted
shall not affect any other section or portion of this ordinance.
SECTION 5: A1.1 ordinances or parts of ordinances in con-
flict herewith are hereby repealed.
SECTION 6: This ordinance shall be in full force and
effect from and after its passage, approval,
and publication in the manner provided by law.
