AN ORDINANCE
Granting a Special Use Permit
• at 1029-35 Davis Street
WHEREAS, the Evanston Zoning Board of Appeals (ZBA)
conducted a public hearing on May 2, 1990, upon the application
of George Radaios, Sam Radaios and Harry Radaios as
beneficiaries under the American National Bank and Trust Company
of Chicago, Trust 10503-09 (owners), and Evanston Franksville,
Inc., (lessed), for a special use to permit establishment of a
type 2 restaurant, without a drive-in facility, on the property
located at 1029-35 Davis Street, in a B4 Business District; said
public hearing having been conducted pursuant to notice and
publication thereof in the manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said special use be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That, based upon the evidence and
testimony presented at the hearing, and
upon deliberations and findings of fact contained in the
transcript of the Zoning Board of Appeals Case No. 90-4-SU(R),
the application of George Radaios, Sam Radaios and Harry Radaios
as beneficiaries under the American National Bank and Trust
Company of Chicago, Trust 10503-09 (owners), and Evanston
Franksville, Inc., (lessee), for a special use to permit
establishment of a type 2 restaurant, without a drive-in
facility, on the property located at 1029-35 Davis Street, in a
B4 Business District and legally described as follows:
SOUTH 134 FEET OF LOT 7 AND THE SOUTH 134 FEET OF
LOT 8 (EXCEPT THE SOUTH 134 FEET OF THE EAST 60 FEET
. OF LOT 8) IN BLOCK 67 IN EVANSTON, A SUBDIVISION IN
THE WEST - SOUTHWEST OF SECTION 18, TOWNSHIP 41
NORTH, RANGE 14, EAST OF THE THIRD PRINCIPAL
MERIDIAN, IN COOK COUNTY, ILLINOIS.
is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the following
conditions:

1. All trash and garbage shall be placed in
sealed containers on the premises and said
containers shall be screened from view from
Oak Avenue;
2. The hours of operation of said type 2
. restaurant shall be limited to 6:00 A.M. to
11:00 P.M., Sunday through Thursday and 6:00
A.M. to 1:00 A.M., on Friday and Saturday;

3. The operator of said type 2 restaurant shall
police up litter of all types in the morning,
early afternoon and evening, one half hour
prior to close in the following area: both
sides of Davis Street for one half block west
and east of the subject property, both sides
of Oak Avenue north from the subject property
to Church Street, including the City parking
lot; -within said block and both side of Oak
Avenue for one half block north of the
intersection of Davis Street and Oak Avenue;
4. Signage shall be as described and be limited
to awning signs as described in the testimony
and in full compliance with the Sign
Ordinance; and
5. Cooking odors from said establishment shall
not be detectable 100 feet from the premises.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force.
and effect from and after'its passage,
approval and publication in the manner provided by law.
