HomeMy WebLinkAboutORDINANCES-1990-032-O-90N 4-4-90 32-0-90 AN ORDINANCE Granting a Special Use Permit 2118 Central Street • WIIEREAS, the Evanston Zoning PP Board of Appeals (ZBA) conducted a public hearing on November 21, 1989, February 20, 1990 and March 20, 1990, upon the application of Ben Karlson, as beneficiary under the First Illinois Bank, Trust R388 (owner) and the Cultured Gourmet, Limited (tenant), for a special use to permit retention of the type 2 restaurant, previously established on the property located at 2118 Central Street, in a B2 Business District; said public hearings having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said special use be granted; NOW, TIIEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF • THE CITY OF' EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearing, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 89-36-SU(R) or T(F), the application of Ben Karlson, as beneficiary under the First Illinois Bank, Trust R388 (owner) and the Cultured Gourmet, Limited (tenant), for a special use to permit retention of the type 2 restaurant, previously established on the property located at 2118 Central Street, in a B2 Business District and legally described as follows: LOT 2 IN BLOCK 18 IN NORTH EVANSTON, IN THE NW 1/4 OF NW 1/4 OF SECTION 12, TOWNSHIP 41 NORTH, RANGE 13, EAST OF THE TIiIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS. is granted, subject to compliance with all other provisions of • the Zoning Ordinance, other applicable laws and the following conditions: 1. Said type 2 restaurant shall be limited solely to the serving of frozen deserts, soups, salads, sandwiches and baked goods and shall not include 1 r 32-0-90 the serving of grilled, broiled or deep fried food; 2. No amusement devices, as defined in Section 3-8-1 of the City Code, shall be established or maintained within said type 2 restaurant; • 3. Said type 2 restaurant shall collect litter at 8:00 P.M., daily and at the close of business, daily within the areas from Hartrey Avenue (west) to Prairie Avenue (east) on both sides of Central Street; from the corner of Hartrey Avenue and Central Street, on Hartrey Avenue, south on the east side of the street to the Central Street/Harrison Street alleyway; from the corner of Hartrey Avenue and Central Street, east to Prairie Avenue on both sides of the street; the Central Street City parking lot and adjacent walkways; Independence Park and adjacent walkways; Ellingwood Park, which is that triangular park lying between Pioneer Road, Hartrey Avenue and Harrison Street; 4. The hours of operation for said type 2 restaurant shall be 11:00 A.M. to 11:00 P.M., Mondays through Thursdays, 11:00 A.M. to 12:30 A.M., Saturdays, and 11:00 A.M. to 10:00 P.M., Sundays; 5. Ingress and egress for patrons of said type 2 restaurant shall be only from Central Street. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. . SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
