HomeMy WebLinkAboutORDINANCES-1990-031-O-9031-0-90 AN ORDINANCE Granting a Special Use Permit • at 1113-19 Emerson Street WHEREAS, the Evanston Zoning Board of Appeals (ZBA) conducted a public hearing on March 20, 1990, upon the application of The Emerson Place Partnership, as beneficiary, under the Heritage Trust Company, Trust 88-3430, and North Shore Pizza, Inc., prospective tenant, for a special use to permit establishment of a type 2 restaurant on the property located at 1113-19 Emerson Street, in an M3 Restricted Manufacturing District; said public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said special use be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF • THE CI'.TY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearing, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 90-1-SU(R), the application of The Emerson Place Partnership, as beneficiary, under the Heritage Trust Company, Trust 88-3430, and North Shore Pizza, Inc., prospective tenant, for a special use to permit establishment of a type 2 restaurant on the property located at 1113-19 Emerson Street, in an M3 Restricted Manufacturing District and legally described as follows: PARCEL 1: TIiAT PART OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 18, TOWNSHIP 41 NORTH, RANGE 14, EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHEAST CORNER • OF RIDGE AVENUE AND EMERSON STREET AND RUNNING THENCE NORTHERLY ALONG THE EASTERLY LINE OF RIDGE AVENUE 75 FT., THENCE EAST ON A LINE PARALLEL WITH THE NORTH LINE OF EMERSON STREET, 163 FT., 'THENCE SOUTHERLY ON A LINE PARALLEL WITH THE EASTERLY LINE OF RIDGE AVENUE, 75 FT. Said proposed type 2 restaurant shall be established in substantial compliance with the testimony presented and the plans placed on file in connection with this case; • 2. The hours of operation of said type 2 restaurant shall be 11:00 A.M. to 1:00 A.M., Sundays through Thursdays and 11:00 A.M. to 2:00 A.M., Fridays and Saturdays; 3. All deliveries shall be from the storefront; 2 0 31-0-90 0 • • 4. Food preparation shall be limited solely to the assembly and baking of pizzas and sales shall be limited solely to pizzas and beverages; 5. No amusement devices, as defined in Section 3-8-1 of the City Code shall be installed or maintained within said type 2 restaurant; ' 6. No more than 15 per cent of the food prepared by said type 2 restaurant shall be sold to persons who drive to the premises or who come to the premises to pick up food, and no food shall be served for consumption on the premises; 7. Personnel. of said type 2 restaurant shall collect litter of all types within the area bounded by Garnett Place on the north, Maple Avenue on the east, Emerson Street on the south and Ridge Avenue on the west, prior to the daily store opening and following the dinner rush period daily, restaurant personnel will periodically inspect the subject premises to pick up all litter, regardless of its origin. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
