AN ORDINANCE
Granting a Variation from the Use
Regulations at 400-14 Davis Street
is WHEREAS, the Evanston Zoning Board of Appeals
conducted a public hearing on October 17, 1989, November 19,
1989, January 16, 1990 and February 20, 1990, upon the
application of The Georgian for a variation from the use j
regulations of the Zoning Ordinance to permit establishment of a
parking lot for 16 motor vehicles on the property located at
400-14 Davis Street, Evanston, Illinois, located in an R1
Single-family Residence District; said public hearings having
been conducted pursuant to notice and publication thereof in the
manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said variation be granted; and
WHEREAS, the Planning and Development Committee does

not concur
with
the Zoning
Board of Appeals
recommendation but
recommends
that
a variation
be granted upon
the condition that
the parking lot located on the Southwest portion of the property
be retained;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That, based upon the evidence and
testimony presented at the hearings, and
upon deliberations and findings of fact contained in the
transcript of the Zoning Board of Appeals Case No.
89-32-V(R), and upon the recommendation of the Planning and
Development Committee, the application of The Georgian for a
variation from the use regulations of the Zoning Ordinance to
permit establishment of a parking lot for 16 motor vehicles on
• the property located at 400-14 Davis Street, Evanston, Illinois
and legally described as follows:
LOTS 1, 2, AND 3 IN BLOCK 25 IN EVANSTON IN THE
SOUTHEASTERLY FRACTIONAL QUARTER OF SECTION 18,
TOWNSHIP 41 NORTH, RANGE 14, EAST OF THE THIRD
PRINCIPAL MERIDIAN (EXCEPT THE SOUTHERLY 60 FEET OF

THE EASTERLY 103 FEET OF LOT 3 AND EXCEPTING THAT
PART FALLING WITHIN THE SOUTHERLY 42 FEET OF THE
WESTERLY 46 FEET OF THE EASTERLY 149 FEET OF LOT 3),
IN COOK COUNTY, ILLINOIS
is denied, but a limited variation is hereby granted to retain
the parking lot legally described as follows:
THAT PART OF LOT 3 IN BLOCK 25 IN EVANSTON, BOUNDED
AND DESCRIBED AS FOLLOWS:
COMMENCING AT THE INTERSECTION OF THE SOUTH LINE OF
DAVIS STREET AND EASTERLY LINE OF ALLEY IN SAID
BLOCK 25, THENCE SOUTHWESTERLY ALONG SAID EASTERLY
RIGHT OF WAY OF ALLEY A DISTANCE OF 198.57 FEET TO
THE POINT OF BEGINNING, THENCE EASTERLY PARALLEL TO
THE SOUTH LINE OF LOT 3 A DISTANCE OF 36.10 FEET,
THENCE NORTHERLY PARALLEL TO THE AFORESAID EASTERLY
LINE OF ALLEY A DISTANCE OF 42.00 FEET, THENCE
i. WESTERLY PARALLEL WITH THE SOUTH LINE OF LOT 3 TO
THE INTERSECTING POINT ON EASTERLY RIGHT-OF-WAY OF

subject to compliance with all other provisions of the Zoning
Ordinance, other applicable laws.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
approval and publication in the manner provided by law.

REC MMENDATION OF THE BOARD OF LOCAL IMPROVEMENTS
TO THE CITY COUNCIL OF THE CITY OF EVANSTON, ILLINOIS
The Board of Local Improvements of the City of Evanston, Illinois,
herewith submits the draft of an Ordinance for the making of a local
improvement within the City of Evanston, County of Cook and State of Illinois,
the nature, character, locality and description of which is as follows,
to -wit: - -
That Barton Avenue, 128.8 feet South of South Line of Harvard
Terrace to the'South line of Harvard Terrace in the City of
Evanston be improved by grading, constructing the necessary
drainage system with concrete curb and gutter and paving to a width
of thirty feet (30') with Bituminous Base Course seven inches (7")
thick and Bituminous Surface Course two inches (2") thick.
and as part of said Ordinance and in conjunction therewith, said Board also
• herewith submits the Plans and Specifications of and an Estimate of the cost
of said improvement, including the cost of engineering services, as finally
determined by said Board, and said Board hereby recommends the passage of said
Ordinance and the making of -the improvement_ described therein.
